HISTORIAL • A partir del siglo xv; potencias extranjeras hacen acto de presencia: Portugueses, Holandeses, Ingleses y Franceses. • Colonia Británica: Dominio ingles férreo. • 1885; se formo el Congreso Nacional Indio liderado por Mohandas Gandhi. • En 1929 Gandhi lidera una fuerza de resistencia pacifica. • 15 de agosto de 1947, día de la independencia. • La Constitución de 1950 contiene un apartado relativo a las garantías individuales: Bill of Rights. • 1955 Ley para prevenir el Tratamiento de Intocables.

Derecho de la India • Anteriormente; era un cuerpo racionalizado y sistematizado basado en la costumbre y en observancias; una colección de «Debes» y «No debes». • Smritis y vedas. • A partir de 1947 se ha presentado un enfrentamiento entre tradicionalistas y reformistas. • Actualmente, La India esta regida por la Constitución de 1950; • Es un Sistema legal hibrido. • Fuentes del derecho: • Costumbre. • Jurisprudencia. • Legislación.
