Dfinityhasregisteredatrademarktodeliver blockchaintechnologyservicesanddecentralized platforms. Meta Dfinityfurtherstatedthatbecausethecolorpalette"is notspecifiedasacharacteristicofthemark,Dfinity's ownershipextendstocolorvariants."
Dfinityevensaidthatitslogohasbeenusedonits websitesinceMarch2017,althoughMeta (previouslyFacebook)registereditslogoinMarch 2022. "Metaunderstandswhathe’sdoing" Metaisawareof accordingtoDfinity. thesimilaritiestoitsbrand, YetMetabelievesthathis Dfinity conceptisonlya“geometricdesignconsistingoftwo loops”,thusheoptedtocontinuehisapplicationsto attainaDfinity-likeoperationalrecord.
Asaresult,DfinityissuingMeta,claimingthattheyhavealreadyobtained trademarkregistrationtoprovidethesameservicesthatMetawishesto provide,suchas"designanddevelopmentofcomputerhardwareand softwareandsoftware";"hostingofThirdPartySoftwareApplications";and "hostingofDigitalContentontheInternet." Dfinityclaimsthatthismaygeneratemisunderstandingamongpotential consumersofitsservices.
“ThesimilaritiesbetweentheMetabrandandtheDfinitybrand,andMeta’s intendeduseofitsbrandinthesamespaceandthroughthesamecustomer baseasDfinity,willconfuseconsumerswillmistakenlybelievethatMetaandits servicesarelinkedto,sponsoredby,affiliatedwithorrelatedtoDfinity,orthat Dfinityanditsservicesarelinked,sponsored,affiliatedorrelatedtoMeta.” "Meta'spastmightjeopardizeDfinity'sfuture" DfinityallegesinitscomplaintthatMetawould"knowingly"violatethelawby utilizinganIP addressthathadpreviouslybeenregisteredwithout authorization.ThecreatorsofICPthoughtthatsuchbehaviorledDfinityto "loseorwillloseincome."
AnothersignificantissueofthecomplaintisthatDfinitydoesnotwant tobeassociatedwithFacebook'spoorimage.Facebook,nowMeta,is involvedwithdatabreaches,unlawfulinformationtrading,andother issuesforwhichtheyhavefacedmanylawsuits. AccordingtoDfinity,thiswouldresultin"severereputationalharmto Infinity,"whichmightbecriticalforthefutureofInternetcomputing protocols,especiallygivenMeta'semphasisonacentralizedplatform. Metadidnotmakeanythoughtsonthecomplaint.
