LEGAL BASIS • Executive Order No. 95, dated June 8, 1993 – CDA as the Lead Government Agency on cooperative promotion, development and regulation. • Memo circular 93-006 dated July 20, 1993 and Memo circular 2000-04 dated July 24, 2000 (Guidelines on coop development) • Board Resolution No. 167, Series of 2007, dated June 22, 2007 approving the amended guidelines for the organization and operation of the cooperative development councils at various levels.

Historical background of the guidelines • The First General Assembly Meeting of the Cooperative Development Councils of the Philippines, Ilo-Ilo City, March 7-10, 2007 • National Meeting of the Interim National Coop Development Council Officers in Vigan, Ilocos Sur, June 21-22, 2007 • Consultation with the interim officers • Approval in principle by the BOA on the proposed amended guidelines • The board designated Administrator Villaseca and Administrator Buagas to finalize the amended guideline • The amended guideline shall be effective January 1, 2008

Why amend the guidelines? • To answer to the demand to standardize organization and operation of coop councils in different levels • (articulated in Ilo-Ilo conference, and discussed in the vigan meeting by the interim LCDOP officers) • To improve coordination efforts by various coop-promoting institutions implementing coop development programs. • To bring coop development services closer to the coop communities. • To strengthen the tripartite partnership (CDA, LGUs, Coop) in coop development

Declaration of Policy • The Cooperative Development Authority (CDA) hereby declares the indispensability of the Cooperative Development Councils as the mechanism to ensure a strong partnership between and among the CDA, other National Government Agencies (NGAs), including the Government Financial Institutions and Instrumentalities (GFIs), the Local Government Units (LGUs), Non-Government Organizations (NGOs) and the Cooperative Movement itself for the purpose of advancing the spirit of cooperativism in the Philippines.

  6. Objectives • Ensure the organization, or if already organized, the reorganization and strengthening of Cooperative Development Councils at the national, regional, provincial, city and municipal levels consistent with this Circular; and • Set the benchmarks and/or basic standards on the operations of the Cooperative Development Councils applicable in a particular level.

  7. Mandate of the Councils • to serve as a mechanism for collaboration, consultation and coordination in the implementation of various programs and projects implemented by all government branches, instrumentalities, subdivisions, and agencies for the cooperatives.

  8. Powers and Functions • To coordinate, harmonize and monitor the implementation of various cooperative development plans, programs and projects of NGAs, GFIs, NGOs, LGUs, and the Councils concerned; • To formulate implementing guidelines and create mechanisms to operationalize and monitor the Medium-Term Cooperative Development Plan (MTCDP); • To maintain, in coordination with the CDA, a database on relevant information concerning the state of the cooperative movement in their respective areas of jurisdiction and periodically mount a campaign to disseminate the cooperative movement’s contribution to the local economy and the movement;

Powers and Functions • To call to a meeting or fora, in coordination with the CDA, all concerned NGAs, GFIs, LGUs, coop-promoting NGOs and institutions, and other cooperative development councils, the primary cooperatives, leagues, unions and federations to discuss various problems, issues and concerns affecting cooperatives within their respective areas of jurisdiction, and to recommend appropriate solutions thereof; • To conduct, or assist in the holding of important events, such as but not limited to, cooperative month celebrations, cooperative summits, cooperative congresses, trainings and the like; • To recognize and promote the observance at all times, of the universally-accepted cooperative principles as embodied in the Cooperative Code in the performance of the above functions; and • To undertake projects and/or activities that may generate funds for its operational stability.

  15. Qualifications and Requirements for membership in the Council • Federations and unions shall submit a Board Resolution designating a permanent and alternate representative to the Council; • The Heads of the NGAs, GFIs, and LGUs shall be the automatic representative of their respective agencies. They may issue a special order, copy furnished the Council, designating their alternate representative. • The respective Heads of a co-op-promoting Non-Government Organization or institution, Cooperative Union and Federation, including the lower-level Councils which are members of higher-level Council. The heads may however issue an order, copy furnished the Council, designating the alternate representative of such organization to the Council; • Resolution of the Member-Council, as the case may be; • Payment of annual membership fee as may be agreed by the Councils.

Council Secretariat The shall perform the following functions: • Prepares the minutes and agenda and records the attendance and proceedings of all meetings of the Councils; • Serves notices of meetings to all members of the Council; • Furnishes the officers and members certified copies of the minutes of the meetings; • Keeps a register of the names and addresses of all members and keeps a complete file of the laws, resolutions and executive orders relevant to the creation of the Council and the registration and businesses of the cooperatives; • In general, performs all duties incidental to the office of the secretariat and those that may be assigned to it by the Chairperson and/or the Council; and • Acts as alternate custodianof books of accounts.

ELECTORAL BOARD Composition • three (3) members, • shall be constituted by the duly elected officers at least one (1) month before the date of general elections. • Board members shall elect from among themselves the Board Chairperson • shall be ineligible to run for any elective position or office of the Council. • shall administer the elections of the Council to insure a free, orderly and honest election. • Board may be considered dissolved after sixty (60) days from the date of the general elections

ELECTORAL BOARD Powers • adopt rules and regulations necessary to govern election procedures, subject to the approval of the Council. • accept electoral contest or protest not later than five (5) working days from the date of elections • decide and settle all contests relative to the conduct of elections of the officers of the Council not later than thirty (30) days from the date of the elections. • order or award of the Electoral Board is final, executory and non-appealable.

MEETINGS Meeting of Officers – • The officers may hold regular meeting, either on a monthly, quarterly, or semi-annual basis as the Councils may desire: Provided, That the first regular meeting shall be conducted not later than January 31 of each year. General Membership Meeting – • for NCDC, shall be conducted every two years during the month of December • For RCDC, PCDC, CCDC and MCDC shall be every year. • General elections for officers and committee members shall likewise be held during a General Membership Meeting. • A special meeting of the council may be called for by the officers of the council as the need arises.

  25. MEETINGS Notice – • A notice, containing the date, place, time and agenda, shall be served either by mail, personal delivery, short messaging system (text messaging) or through facsimile transmittal or any means approved by the council, to every member at least five (5) days before the date of such meeting for MCDC/CCDC, seven (7) days for RCDC and fifteen (15) days for NCDC . Quorum – • shall consist of at least 5 members present. • may decide all matters at the meeting.

  28. MISCELLANEOUS PROVISIONS Transitory Provision – • The Councils shall initiate organizational adjustments to conform to the provisions of this Memorandum Circular not later than FY 2008.
