  1. Dispensary Laws – All You Need To Know It has been nearly a decade since lawmakers legalized the use of marijuana products in the state of Colorado. Yet, while many have been reaping the benefits of what turned out to be a gigantic shift in the legal perspective on the use of the recreational plant, few are still aware of the laws and regulations that the dispensary near you needs to uphold to maintain their license. The team at Rocky Mountain Cannabis was amongst the first to obtain this legal requirement from local government and has since then been able to expand their business to nine locations across the state. This achievement is making them the perfect source to provide an overview of the finer details regarding maintaining your reputation in the industry. First, it is important to understand why marijuana dispensaries or pot shops even exist. The reason behind the existence of these exclusive facilities is that when the government legalized the use and sales of marijuana products, they wanted to maintain a distance between conventional dispensaries and the trade of this natural remedy. Yet, they needed to have control over sales of this kind of product and had to make sure that who was allocated the right to sales of recreational products would maintain proper recordkeeping of sales. Thus, the idea of marijuana dispensaries turned out to be the solution to this concern. Some of the laws that these dispensaries have to adhere to include the fact that nobody younger than 21 years of age can apply for a dispensary license. As nobody younger than 21 years of age are even allowed to enter such premises or to enter their online platform, this rule should be expected. Yet, there are more to consider. Anyone applying for a license to open a marijuana dispensary needs to have been a resident in the state for at least two years or they should be legally married to someone who has been a resident for this long. The state will run a comprehensive background check on you and if they find that you have any conviction in terms of substance possession or distribution, they will immediately disqualify your application. You are also not allowed to have any felony convictions for at least the last five years before your application. You would need to pass a much wider check that will include an investigation into your moral history. How the state achieves this is by considering your background for any criminal charges but you would also need to submit a letter stating your character that you must obtain from your local police station. Lastly, no employee of the local or the State Licencing Authority has the authorization to apply for a dispensary license. This would mean that you are also excluded from making such an application when you work for the sheriff or the prosecuting office. These are the state’s requirements in terms of owners, employees, and even partners to any pot dispensary. However, there are more rules in place. When you are an employee at such a dispensary, you may not use any of the products on offer. Employees, may and should do random drug tests on their employees and the outcome of these tests will determine your employment at the dispensary. Employers of dispensaries are allowed to employ policies regarding their products while their employees are present on their premises. They have the authority to employ policies that are stricter than the state rule and are prohibited from being any more lenient than government stipulations. The use of any of these products on any business property, including the property of the dispensary, is illegal unless it is taking place in an enclosed space allocated for the use of marijuana products. While these rules might be strict, it is how the local government manages to maintain an honest industry.
