Protests based upon alleged improprieties in a solicitation which are apparent prior to bid opening or the time set for receipt of initial proposals shall be filed prior to bid opening or the time set for receipt of initial proposals. In procurements where proposals are requested, alleged improprieties which do not exist in the initial solicitation but which are subsequently incorporated into the solicitation must be protested not later than the next closing time for receipt of proposals following the incorporation. <br>

Government Accountability Office Attn: Procurement Law Control Group 441 G Street, NW Washington, DC 20548 By email to GAO and to Protester Dear Mr. Morrow: The Army intends has taken corrective action in this protest, as follows: the Army has cancelled the award of bridge contract W52P1J-14-C-0047, and will extend the current contract, W911SE-07-D-0014 BA 01 in accordance with FAR 16.505 and 52.217-8. The Army believes that this action renders the pending protest moot as there is no longer an issue before the GAO which must be decided at this time. As this renders the protest academic, no further purpose would be served by the GAO’s review of the protest.
