  2. What is Medical Malpractice? Medical malpractice occurs when a patient suffers a serious injury while under the care of a healthcare provider which could have been prevented if that healthcare provider acted as a competent peer would have under the same circumstances. Medical malpractice can result in catastrophic injuries (including organ failure, brain, and spinal cord injury) and even death.

  3. Types of Medical Malpractice Cases Types of medical malpractice and medical negligence cases include: 1. Birth injury  2. Diagnosis errors 3. Medication errors 4. Surgical errors

  4. BIRTH INJURY A birth injury is an injury suffered by a newborn during the labor and delivery process. Birth injuries can be grounds for legal action when they are the result of medical negligence on the part of a doctor, nurse, or other member of the delivery team. Common errors include the improper use of forceps or suction devices and failure to ensure adequate oxygen to the fetus.
