WHAT IS IT? • authorizes EPA to set tolerances, or maximum residue limits, for pesticide residues on foods • a food containing such a residue is subject to seizure by the government • When a tolerance is set, the residue is the trigger for enforcement actions and if residues are above the level, the item will be subject to seizure. • To determine the maximum residue, EPA considers: the toxicity of the pesticide and its break-down products, aggregate exposure to the pesticide in foods and from other sources of exposure, and any special risks posed to infants and children.
WHO IS INVOLVED? • The EPA (Environmental Protection Agency) is in charge of the regulation and enforcement for the FFDCA
