IDEA • The statute provides that: • to the maximum extent appropriate, children with disabilities, including children in public or private institutions or other care facilities, should be educated with children who are not disabled, and that special classes, separate schooling, or other removal of children with disabilities from the regular classroom should occur only when the nature or severity of the disability is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily…20 U.S.C. 1412(a)(5)(B)

  3. Continuum of Placements • School districts must ensure a continuum of placement to meet individual needs, as determined by the IEP committee. • Regular classes • Regular classes with accommodations • Special classes • Special schools • Home instruction • Hospitals and institutions

  4. Placements • Decision based on IEP. • In school they would attend if nondisabled unless the IEP requires some other. • Consideration MUST be given to any harm that would be caused to the child. • Quality of services that the child needs is also a factor. • THEY MAY NOT be removed from regular classroom only because of needed modifications in the general curriculum.

  5. Nonacademic Settings • A school district must ensure participation with nondisabled children to the maximum extent appropriate. • Including meals and recess.

  6. Extracurricular Services • A school district must ensure participation with nondisabled children to the maximum extent appropriate.

  7. Important Note • While LRE is not the only consideration, it should be CLEARLY understood that it presumes NONSEPARATION.
