LAW RELATING TO INVESTMENT AND EXPORT PROMOTION • Articles with positive impact • Article 29 al 2, states that tourism industry is highly regarded among other priorities for investments in Rwanda. • Article 16 states that the holder of a certificate of registration of an investment project is entitled to rights of benefits provided for by the law and related to facilitation for importers • Annex I provides thatan investor who imports aeroplanes for transportation of tourists is exempted from payment of taxes

ImmigrationLaw Cont…….. • Articles with negative impact • Article 5 may as well impact negatively to a tourist who would like to stay more days to accomplish the touristic mission in the country. • We recommend if a person loses his / her travel documents, he/ she shall upon reporting any such loss obtain a temporary travel document that may facilitate him/her to enjoy the rights entitled to him/ her from that lost travel documents until the day of intended exit – end of his tourism as had been scheduled other than providing him/her with the document that would facilitate his/her exit only.

LAW RELATING TO CIVIL AVIATION AUTHORITY • Article 14 of Law No. 42/2011 of 31/10/2011 Relating to Civil Aviation Authority requires a special certificate issued by the Civil Aviation Authority (CAA) to Hotels and Catering service suppliers. • This law directly affects positively the Tourism business by imposing precautions to be undertaken; • It is also a hindrance to doing business since CAA is joining in as a regulator alongside other institution’s like RDB, RURA, MINISANTE and others. • Article 18 up to article 32 impact positively on tourism by offering a security protection for the passengers

LAW GOVERNING ROADS IN RWANDA • Article 3 of law no 55/2011 of 14/12/2011 governing roads in Rwanda classify the public roads into 3 classes but the 3rd class refer to all roads that link areas of tourist significance. • Until now these roads indicated in the aforesaid article are insufficient and some tourist attractions are in remote areas and accessing them would be a constraint.

  6. RECOMMENDATIONS • As with all other industries, tourism requires basic infrastructure to function. • Tourism developments require a set of utilities in order to function properly. • Despite the foregoing developments, and protection of tourism industry in Rwanda has not realized its full potential due to various problems. • That is why we recommend that: • Tourists travelling around Rwanda should expect a level of quality of roads as well as of transport provision to take them speedily but also comfortably to their destinations. • There needs to be harmonized regulatory platform or supervision and licensing authority setting out a number of requirements to be fulfilled by investors in the sector prior to being licensed as this shall avoid or at least mitigate negative surprises in the business;
