  2. Lawyers • Can work in/for • The government • Corporations, unions, or trade associations • Public interest groups • But most work in private practice • Lawyers who go to court are called litigators

  3. Reasons for needing a lawyer • Forming a corporation • Caused an accident where someone is seriously injured • Someone is charged with a serious felony

  4. Finding a lawyer • Best way is to get a recommendation from someone who had a similar problem that was resolved satisfactorily. • Can also get a bar association referral, look in the phone book or law directory.

  5. Questions to ask when hiring a lawyer • What will the total charge be? • Who else will be working on the case? • Do you use contingency fees?

  6. Contingency Fee • A fee an attorney receives based on a percentage of what his/her client wins in a case. • Fees are deducted from the winnings • Client pays nothing except expenses if case is lost. • Often used for clients who have a good case but don’t have money for an attorney.

  7. Retainer • A down payment for a lawyer’s services

  8. Advertising for Lawyers • Protected by the first amendment (right to free speech)

  9. Attorney-Client Privilege • Ensures that information told to one’s attorney is confidential/private • Encourages a client to speak freely • Information told to one’s attorney may only be released with the client’s consent. • Only pertains to information that is told in confidence.

  10. Code of Professional Responsibility • Standards of conduct that guide lawyers’ conduct • Lawyers who violate state ethical requirements can generally face • Disbarment • Reprimand • Suspension

  11. Disbarred • A lawyer no longer has a license to practice law

  12. Legal Malpractice • A case in which a lawyer sues another lawyer for a serious error that caused a former client to lose his or her case.

  13. Public Defender • Represents criminal defendants who are too poor to hire a lawyer.

  14. Legal Aid Organization • An agency that provides representation to low-income people on their civil legal problems. • Ex. ACLU, Southern Poverty Law Center

  15. Bar Association • An organization of attorneys that provides support for it’s members and the public.
