  1. ON TRIAL A Courtroom Case From Tuck Everlasting

  2. BACKGROUND • Mae Tuck has been charged with the murder of the Man in the Yellow suit as she struck him on the back of the head with a shotgun. • Mae Tuck has been sent to trial by jury so that the people of the community can determine whether or not she is guilty and any relevant punishment.

  3. ROLES and EXPECTATIONS • JUDGE: played by the teacher, who’s role will be moderate the proceedings.

  4. ROLES AND EXPECTATIONS • PROSECUTORS (Lawyers): Prove that Mae Tuck is guilty of murder and should be sentenced to death. You need to create questions for the witnesses and comments to make to the jury to convince them why you are right and that Mae killed the man in the yellow suit and consequently should be hung. You must choose 2-3 witnesses to question.

  5. ROLES and EXPECTATIONS • DEFENDANTS (Lawyers): Prove that Mae Tuck is innocent and should be freed. You need to create questions for the witnesses and comments to make to the jury to convince them why you are right and that Mae is innocent and should be freed. You must choose 2-3 witnesses to question.

  6. ROLES and EXPECTATIONS • WITNESSES: Honestly answer the questions the lawyers ask you according to your character. To prepare you need to be very familiar with the events of the story as they affect your character. Think about the events you've experienced and the relationships you have with other characters.

  7. WITNESSES • Mae • Winnie • Jesse/Miles/Angus • Constable • Mr. Foster • Grandmother

  8. ROLES and EXPECTATIONS • JURY: To listen carefully to the lawyers and to the witnesses, and being objective as possible, to make a decision about whether or not Mae is guilty. Once you have made a decision, you must also decide on a punishment if necessary. To prepare you must work as a group to determine what OBJECTIVE means and create a poster to show what the concept means and why it’s important.

  9. COURTROOM PROCEEDINGS • Witness Examination -Lawyers ask witnesses their questions 2. Closing Arguments -Lawyers summarize their arguments, with reference to the witness statements and create a final argument as to Mae Tuck is or isn’t guilty of murdering the Man in the Yellow Suit • Deliberation - Jury makes a decision (majority wins) 4. Sentencing - Verdict (and punishment) are read by the jury

  10. DISCUSSION and REFLECTION • Talk about the trial, what went well, what didn’t. Do you think the outcome is fair etc. • FOR HOMEWORK: • Write a 1/2 to 1 page reflection on the events of the trial, the role you played in the proceedings, and your thoughts on the process. What is your opinion about the verdict? Do you agree or not? Support your answer with evidence from the book.
