What do you think the national government is NOT allowed to do? • Violate the Bill of Rights • Put export taxes among states • Use money from the Treasury Department without approval • Change state boundaries • Grant title of nobility • Permit slavery (13th amend.) • Deny citizens the right to vote (15th and 19th amend.)
What do you think the state governments are NOT allowed to do? • Enter treaties with other countries • Print money • Tax imports or exports • Violate the Constitution • Take away a person’s rights without due process (DPL!!)
#1: Bills of Attainder • Punishing people without a trial - VIOLATES DPL!! Ex. – ALL citizens are given a trial before being found guilty or innocent.
#2: Ex-Post Facto Laws • Laws that criminalize acts that were previously legal • Cannot be punished for performing an act if it was done while legal Ex. –drinking at the age of 18 before the legal age became 21.
#3: Suspension of Habeas Corpus • Illegally “obtaining” (jailing) someone without there being enough evidence • CAN ONLY HAPPEN IN THE EVENT OF AN EMERGENCY, CRISIS, OR THREAT TO CITIZENS SAFETY! Ex. – during Civil War, Lincoln suspended the rights of some individuals and jailed them.
