Ley N° 27178 - Ley del Servicio Militar Los Arts. 8°, 43°, 53° y 55° señalan que el servicio puede ser prestado en el activo y en la reserva; forman parte del activo los jóvenes voluntarios quienes pueden cumplir con el servicio bajo las modalidades de acuartelado, no acuartelado y comités de autodefensa; la reserva está conformada por los seleccionados que no se incorporen voluntariamente al servicio activo, los no seleccionados, los licenciados y ex cadetes y ex alumnos de los institutos armados y policía nacional; están obligados a concurrir a los llamamientos con fines de instrucción y entrenamiento, movilización o grave amenaza o peligro inminente para la seguridad nacional. Esta disposición determina que el servicio militar sea considerado como parcialmente voluntario. La interpretación de amenaza o peligro inminente podría ser arbitraria y bastante subjetiva. No incluye la objeción de conciencia.
