To give an answer to this question once and for all, we have found an official article on the site of governmental justice. According to the Supreme Court in 1998 poker is seen as gambling within the law of gambling. Under Article 1 of this Law it is prohibited to organize gambling activities without a licence. On occasions, if organized from a commercial point of view, the law on gambling does not apply. In all other cases a permit is required. You can not apply for a permit for organizing a poker tournament, because under Article 27h of the Law on gambling Holland Casino is the only one permitted to organize such a tournament. According to the Disposition of Casino Games 1996 poker is a casino game. Playing poker at home with a bunch of friends is allowed when it doesn’t bring on commercial benefits. Non-commercial means, in this case, a tournament that takes place in a home environment. It gets commercial when tournaments are organized on a regular en systematic basis, and the organization asks entrance fee or a rake. A poker tournament in a cafe will be open to the public and commercially organized. However, a group of friends can play poker in a cafe, only when it is a private occasion.
