LICENSING ACT 2003 - THE LAW Serving Alcohol to Guests - Potential For Drunkenness • Under the Licensing Act it is an Offence for YOU to serve somebody who YOU suspect is under the influence or is affected by Alcohol (I.e. Drunk or Potentially Drunk) • It is also an Offence for YOU to serve a companion of somebody you suspect is under the influence or affected by alcohol • Penalties Are Personal to YOU • Failure to Comply £20000 Fine and / or 6 months in Prison • Police can impose on the spot fines (You, Guest/Companion)
