Photo processing solution take-back duty in Belgium • background : • original proposal in Walloon region : not limited to waste of photochemicals but included waste of photographic film, paper & printing plates • opposed by photographic companies (Agfa - CPAC - Fuji - Kodak) + federation of chemical industry (Fedichem - Walchim) • withdrawal from list of waste-subjects with pending regulations not successful • narrowing down to liquid photographic waste achieved

Photo processing solution take-back duty in Belgium • present status : • narrowed down proposal voted by Walloon Government on April 25th and law published on June 16th 2002 (KB 2002-2081) • new regulation establishes a tack back duty for all liquid photographic waste in the Walloon region, including developers, fixers and activating baths • new regulation foresees in several implementation possibilities to comply • approval in the 2 other regions expected before end of 2002

Photo processing solution take-back duty in Belgium • ongoing actions of photographic companies in Belgium : • meeting on October 4th with main players in Belgium • Agfa - CPAC - Fujihunt - Kodak • representing > 95% of manufactured or imported photochemicals • meeting on November 4th with Fedichem • Agfa - CPAC - Fujihunt - Kodak + Fedichem

Photo processing solution take-back duty in Belgium • meeting with main playersof Photographic Industry in Belgium : • goal = join forces and take initiative with respect to the implementational aspects of the published law • outcome = consensus with respect to the following general principles • compliance should be organised on a sectorial basis, not individually • compliance should be organised through the possibility of a sectorialagreement with the Regional authoritiesallowing the specific modalities to be defined • establish a new ‘VZW’ (organisation without profit goal) • photographic processing solution waste from individual consumers : to be organised by the VZW at the expence of the VZW • photographic processing solution waste from industrial consumers : keep the present model = choice of specialised company for haul-away and treatment at the expence of the industrial / professional consumer

Photo processing solution take-back duty in Belgium • meeting with main playersof Photographic Industry in Belgium : • outcome 2 = consensus with respect to the approach in contacts with authorities • identification of members of VZW • identification of tasks for VZW • identification of items that should be excluded from tasks for VZW • identification of aspects where further (legal) advice is required
