  1. Kidnapping Often punishments are more severe than crimes against property

  2. Kidnapping • Moving one person to another place without consent • If person is under 16, moving a person without the consent of the parent or guardian

  3. Is this Kidnapping? • Beze asks Kyle to go to the movies. Kyle does not want to go, so Beze grabs him and places him in the car and drives him to the movies. During the movie, Kyle is taped to the movie theater chair.

  4. Is this Kidnapping? • Angela takes Steven to Kings Dominion without asking his parents. Steven is 11 years old.

  5. Is this Kidnapping? • Beze asks Kyle to go to the movies. Kyle doesn’t really want to go, but Beze pleads with him to go. Kyle finally decides to go, but he wants to be at home.

  6. Kidnapping Purpose • The intent must be: • Obtain a ransom • Keep as a hostage • Use the person as a shield • To commit a felony • Helping someone who committed a felony escape • Causing bodily harm to the person • Keeping the person in servitude • Trafficking(taking) a person to be placed in servitude

  7. Kidnapping Punishments • 1st Degree: Kidnapped person is not released in a safe place or physically/sexually assaulted • Class C Felony • 2nd Degree: Kidnapped person is released in a safe place and NOT physically/sexually assaulted • Class E Felony
