National Pollutant Discharge Elimination System (NPDES) Stormwater Program Overview • Required by the Clean Water Act, the Program regulates discharges of stormwater into surface waters of the state from certain: • Municipal Separate Storm Sewer Systems (MS4) • Construction Activities • Industrial Facilities • The primary method to control stormwater discharges is the use of best management practices (BMPs). 2 March 12, 2009
NPDES Stormwater ProgramMunicipal Separate Storm Sewer Systems (MS4s) Regulated MS4s are required to develop and implement a stormwater management plan to reduce contamination of stormwater runoff and prohibit illicit discharges. An MS4 is a publicly-owned conveyance or system of conveyances (ditches, curbs, catch basins, underground pipes) that is designed to discharge stormwater to surface waters of the State. 3 March 12, 2009
NPDES Stormwater ProgramConstruction Activities Process 3,500 - 5,000 Notices of Intent (construction permits) each year. Require regulated sites (ultimately disturb >1 acre) to implement BMPs to minimize erosion during construction. 4 March 12, 2009
NPDES Stormwater ProgramIndustrial Activities Regulate over 2,700 industrial facilities. Facilities are required to implement appropriate pollution prevention techniques to reduce the contamination of stormwater runoff. 5 March 12, 2009
NPDES Stormwater Permitting Process • Notice of Intent forms (NOIs) are submitted to the Department by mail. • Delays can result from incorrect/incomplete applications. • Application fees can only be paid by check or money order. 6 March 12, 2009

Paper v. iNOI Paper iNOI NOI completed online-no paper or mailing required. Application fees payable by Visa or MasterCard. No RAIs! Smart forms are designed to prevent incorrect data/blank responses. Acknowledgement Letter is sent to the operator by email.
