  2. Closing Committees • Expend and report all remaining funds • Repay or forgive any outstanding loans • Satisfy all debts and obligations • File a Final Report • File a CRO-3400 Certification to Close

Closing Committees • (1) Donations to an organization described in section 170(c) of the Internal Revenue Code of 1986 (26 U.S.C. § 170(c)), provided that the candidate or the candidate's spouse, children, parents, brothers, or sisters are not employed by the organization. • (2) Contributions to a national, State, or district or county committee of a political party or a caucus of the political party. • (3) Contributions to another candidate or candidate's campaign committee. • (4) To return all or a portion of a contribution to the contributor. • (5) Payment of any penalties against the candidate or candidate's campaign committee for violation of this Article imposed by a board of elections or a court of competent jurisdiction. • (6)  Payment to the Escheat Fund established by Chapter 116B of the General Statutes. • (7) Contribute up to $4000 per calendar year to a Legal Expense fund.

  4. Independent Expenditure Entities and Electioneering Communication Entities • File initial report • Continue to file reports on regular schedule • Write letter once there will be no more activity • Electioneering Communication reports filed with SBOE

  5. Threshold Candidates • Candidates under Threshold on 2012 ballot • If all funds have been expended, they should file a Certification to Close • If funds remain, they should file a new Threshold Statement for the next election cycle (no later than January 31, 2013) • January 1, 2013 starts a new election cycle

  6. Auditing • Auditing training, email request to : jane.steffens@ncsbe.gov

  7. County Committee Project Send copies of the following: • Statement of Organization • Certification of Treasurer • Certification of Threshold • Certification of Inactive Status • Certification to Return to Active Status • Certification to Close

  8. County Committee Project Send originals of the following: • Certification of Financial Account Number Information • Candidate Designation of Committee Funds • Personal Representative Designation of Committee Funds

  9. Notice of Report Due • 2012 Candidates and any active local PACs receive a notice for the 2012 Fourth Quarter • Candidates still active from a prior year receive a notice for the 2012 Year End Semi Annual (such as municipal candidates) • Local Referendum Committees receive a notice for the 2012 Supplemental Final
