  2. 5GHz Consultation Process • Final Stage consultation document and draft Interface Requirement for 5GHz band were published on RA website in mid-December 2001 asking for comments. • Final Stage consultation document contained 4 proposals. • Closing date for comments, 15 February 2002. SMAG 01/19

  3. Proposal 1 • Make all 3 Bands licence exempt • All equipment must meet requirements of appropriate IR . SMAG 01/19

  4. Proposal 2 Band A (5150 - 5350MHz) • all devices will be nomadic/mobile. • All devices should comply to ERC Decision 99(23) and IR 2006. • Indoor Use only. Max EIRP 200mW Band B (5470 - 5725 MHz) • all devices will be nomadic/mobile. Max EIRP 1W • All devices should comply to ERC Decision 99(23) and IR 2006. SMAG 01/19

  5. Band C (5725 - 5875 MHz) • All equipment should comply with IR2006. Max EIRP of 2W. • All Devices Fixed. • IR 2030 with maximum EIRP of 25 mW will still apply. SMAG 01/19

  6. Proposal 3 • Band C ideal candidate to implement a database showing the locations and other technical parameters of stations deployed in this band. • RA to ensure that site information is made publicly available. • The identities of operators would not form part of the publicly available material. SMAG 01/19

  7. Proposal 4 For RLANs without DFS/TPC as standard an interim proposal was made • Maximum EIRP of 50mW without TPC as standard • Maximum EIRP of 200mW with TPC only as standard • Indoor use only in the band 5150-5250 MHz. • This proposal to be reviewed at future date. SMAG 01/19

  8. Summary of Responses • 28 Responses were received. • Non-confidential replies published on RA website. • Majority of negative replies focused on mainly two issues • Use of band C for higher power Fixed services (Proposal 2) • Interim proposals for band A (proposal 4) SMAG 01/19

  9. Interim Solution • IR 2006 to be rewritten without Band C proposals. Band C requires further sharing studies before it can be released • To contain the following conditions. • Band A (5150 - 5350MHz) • all devices will be nomadic/mobile. • All devices should comply to ERC Decision 99(23) and IR 2006. • Indoor Use only. Max EIRP 200mW SMAG 01/19

  10. Band B (5470 - 5725 MHz) • all devices will be nomadic/mobile. Max EIRP 1W • All devices should comply to ERC Decision 99(23) and IR 2006. SMAG 01/19

Reality (as of June 2002) • To open the market quickly IR 2006 to contain the following interim conditions. • Band A (5150 - 5350MHz) • all devices will be nomadic/mobile. • Indoor Use only. • Max EIRP 60mW without TPC • Max EIRP 120mW with TPC (3dB mitigation) • Random Channel Selection Mechanism to cover all Band A. Regulatory Process • New IR 2006 to go for EU notification (3 month process) • Minister submissions to be done in parallel • To decide whether to allow provision of public services in 5GHz • To contain redrafted licence exemption SI • To contain Regulatory Impact Assessment for 5 GHz • Lay Regulations in Parliament by end Sept SMAG 01/19
