  2. 4 February 1987 Congress passed PL 100-4 the last systematic amendment to the Federal Water Pollution Control Act (Clean Water Act) codified at 33 U.S.C. § 1251 et seq. Among the provisions added was § 1377 dealing with Indian tribes which allowed federally recognized tribes to be considered as “States” for the purposes of § 1313 dealing with development and implementation of water quality standards. The Pueblo of Isleta was the first tribal government in the country to successfully complete all of the bureaucratic hurdles and have its standards approved (1993) by the US Environmental Protection Agency.

  3. WATER QUALITY STANDARDS 40 CFR § 131.2   Purpose. A water quality standard defines the water quality goals of a (1) water body, or portion thereof, by designating the (2) use or uses to be made of the water and by (3) setting criteria necessary to protect the uses.

  4. States adopt water quality standards to protect (1) public health or welfare, (2) enhance the quality of water and serve the purposes of the Clean Water Act . . . [which] means that water quality standards should, wherever attainable, provide water quality for the (3) protection and propagation of fish, shellfish and wildlife and for (4) recreation in and on the water and take into consideration their use and value of (5) public water supplies, . . . and agricultural, industrial, and other purposes including navigation.
