Why NVRA?NVRA Training – SOS The National Voter Registration Act Of 1993 Congress enacted the National Voter Registration Act of 1993 (also known as the "NVRA" and the "Motor Voter Act"), 42 U.S.C. 1973gg-5(a), (b), to enhance voting opportunities for every American and to remove the vestiges of discrimination which have historically resulted in lower voter registration rates of minorities and persons with disabilities. 2

Provisions Of NVRA (continued)NVRA Training – SOS Agency-based Voter Registration (voter registration opportunities must be offered to each applicant for services, service renewal or address change through all offices that provide public assistance and all offices that provide state-funded programs primarily engaged in providing services to persons with disabilities; applicants must be provided with a voter registration form, a declination form, assistance in completing the forms and forwarding the completed applications to the appropriate state official) (42 U.S.C. 1973gg-5); and 4

VR Form SEL 503NVRA Training – SOS • The Agency Voter Registration Card includes: • A Declination- Federal requirement • Documents the interaction • Must be retained for 24 months • A Voter Registration Card • Portion of the form completed by the client andsent to a county elections office • 3. Interacting with the ClientNVRA Training – SOS • “If you are not registered to vote where you live now, would you like to register here today?” That is the question!! • If client answers YES: • Client completes and signs the voter registration card • Provider detaches declination and retains for 24 months • Privately or client may request help from the provider • On-site or the client may take the form home • If they take it home detach the declination from the card • Remind them of the HAVA ID requirements for mailing the card via USPS (See slide #15). 11

  12. Completing the DeclinationNVRA Training – SOS • If client answers NO or does not fill out the voter registration card: • Assume the client chooses not to register and retain declination on file for 24 months. 12

HAVA ID RequirementsNVRA Training – SOS • As of January 1, 2006 individuals must provide one of the following when registering to vote: • An Oregon DMV Driver’s License or Identification number. If the client has an Oregon DMV Driver’s License or Identification number they must provide that number. If the client attests that they have neither they must provide: • The last four digits of your Social Security number (can only be used if the client attests that they do not have an Oregon DMV Driver’s License or Identification number). 13

HAVA ID Requirements NVRA Training – SOS • If an individual has neither an Oregon DMV Driver’s License/ID or a Social Security number and is registering by United States Postal Service mail and: • It is their first time registering in Oregon or; • They have moved to a new county and are updating their information • They must include a copy of a valid form of identification 14

  15. HAVA ID RequirementsNVRA Training – SOS • Examples of a valid ID is a copy of one of the following showing the client’s current name and address: • A current photo identification i.e. driver’s license; • A paycheck stub; • A utility bill; • A government document; or • A bank statement. 15

  16. Completing the Voter Registration CardNVRA Training – SOS Qualifications: To vote in Oregon you need to be registered in the county where you have residence. You can register if you can answer YES to these three questions: 1. Are you a resident of Oregon? 2. Are you a US citizen?* 3. Are you at least 18 years old?* *In some cases you can register to vote before you turn 18 or before you become a citizen. 16

Completing the Voter Registration CardNVRA Training – SOS • Personal Information: • Name: Full name required • Home Address: This must be the address of residence • Include apartment number or space number. • No business addresses. • If homeless the client must provide a physical location. • Mailing Address: Must be provided only if different than residence address. 17

Completing the Voter Registration CardNVRA Training – SOS • Political Party: • Check one (1) only: Optional* • If the client does not want to affiliate with any party, they are not required to do so, mark “not a member of a party”. • *Major political parties require you to be registered as a member of their party in order to vote for their candidates in the Primary Election. 18

  19. Completing the Voter Registration CardNVRA Training – SOS • Sign and Date the Form: • Unsigned forms are rejected. • A client who cannot sign must make a mark. The provider may then write “(His/Her Mark)” next to it. • A person with a disability who is unable, due to the disability, to sign the card may use a signature stamp.* • Power of attorney CANNOT be used for voter registration. 19

Completing the Voter Registration CardNVRA Training – SOS *Signature Stamp Attestation: A person who needs to use a signature stamp or other indicator of the person’s signature shall attest that the person needs to use the stamp or indicator due to a disability. The attestation shall be made at the time the person registers to vote or updates a registration and shall be made on form SEL 540 designed and supplied by the Secretary of State. 20

Completing the Voter Registration CardNVRA Training – SOS Previously Registered: If previously registered and changing personal information, complete this section in addition to the personal information section. The client can change their political party at anytime. However, if they change their party affiliation before the Primary election the change must be received in the county elections office no later than the 21st day before the date of the Primary Election. Postmarks do not count. Make sure the client signs and dates the registration card. The client must include valid ID if they have moved to a new county and are updating their registration by USPS. 21

Processing Completed VR CardsNVRA Training – SOS • Provider should review each card to ensure that it is complete and legible. • Information that Provider reviews for is: • Elector has answered Yes or No to the following questions: • Are you a citizen of the United States of America? • Will you be 18 years of age on or before election day? • Name of elector • Residence Address • Date of Birth • Elector has completed Section 4 regarding Driver’s License/Identification or Social Security number • Elector has signed the registration card 22

  23. Processing Completed VR Cards NVRA Training – SOS If unsure, forward the completed card per normal procedures to the county elections office. Do NOT destroy any cards that have been completed or that indicate in any way that the individual attempted to register to vote. Each person must be provided the same degree of assistance as is provided to complete agency forms, unless the person refuses such assistance.

  24. Processing Completed VR Cards NVRA Training – SOS Separate the voter registration card from the declination. The Agency must keep the declination in their files for 24 months. DO NOT mail them to SOS or the county elections office. Date Stamp each completed card the SAME DAY they are received: • Stamp (or write) the date on the card below the postage area on the addressed side of the card. • The agency date stamp determines when a person becomes eligible to vote if the card is complete.

On the Fifth Day…NVRA Training – SOS Send completed voter registration cards to the county elections office in which the agency is located within 5 calendar days of receipt.* * ORS requires a 5-day turnaround for returning completed voter registration cards. The office of the Secretary of State has the authority to hold the agency staff in violation of this statute. Elections Division recommends that cards be mailed on the last business day of each week if the 5-day turnaround can be met. 25

Voter Registration VerificationNVRA Training – SOS • How does a client know if their registration was accepted? • Precinct Memorandum card • Mailed by the county elections office. • Should be received within 30 days of submitting voter registration card, if not • Client should contact their county elections office • Client can also call the county elections office to confirm their voter registration was accepted. 26

The NVRA ConnectionNVRA Training – SOS • Newsletter published by Elections Division • Sent to all appropriate agencies. • Includes election dates and registration cutoff dates • If it is close to or on a registration cutoff day priorto an election, agencies should send the cards in that same day. 27

Agency Voter Registration ReportingNVRA Training – SOS Voter Registration Report Form SEL 504: Report should be sent in weekly, however, it may be sent at the end of each month as long as it accurately reflects the number of voter registrations forwarded to the county. Mail completed SEL 504 to the Elections Division Mail completed voter registration forms to the county elections office in special envelopes provided by your agency coordinator. Agencies must use USPS unless they have made other arrangements with the county elections office.

  30. Agency Voter Registration ReportingNVRA Training – SOS State Elections must report statewide monthly voter registration totals to the Federal Election Commission using the Agency Voter Registration Reporting Forms returned from the agencies. 30

ORS 247.208(3)NVRA Training – SOS • Employees who offer persons an opportunity to register to vote shall not: Display anything that suggests a political preference or party allegiance. • Influence or attempt to influence persons to choose or not choose a particular political party preference or to register or vote in any particular manner. 31

ORS 247.208(3)NVRA Training – SOS • Employees who offer persons an opportunity to register to vote shall not wear or display material that: • Identifies past, present, or future seekers or holders of partisan elective office; • Contains logos or other graphics that might be identified with a political party or preference; and/or • Would reasonably be understood to be associated with a political party or political preference. 32

Agency NVRA Contact Information NVRA Training – SOS • Each agency will notify Elections Division in writing: • The name of an agency-wide coordinator. • The email address of the agency-wide coordinator. • The location of each agency registration site. • Changes in agency site address or site coordinator MUST be reported to the Elections Division within 10 days of the change. 33

  34. Agency NVRA Contact Information NVRA Training – SOS • Additionally, each agency will provide to the appropriate county election official within 30 days of request or selection: • Name of a contact person for each site. • A list of agency registration sites in the county. 34

Non-Compliance ConsequencesNVRA Training – SOS • Agencies that fail to comply with NVRA face the following: • Federal audits; • Withholding of Federal funds; • Fines by the Federal Elections Commission; • Violation of 5-Day turnaround (a violation of this statute may result in a maximum penalty of $250.00). 35

  37. Additional InformationNVRA Training – SOS Who May Register? Any Person who is: A resident of Oregon A person who lives in Oregon with the intention of making Oregon their home. A person who has come to Oregon for temporary purposes and intends to return to another state is not considered a resident for voting purposes. If applicants are uncertain about residency, refer them to their county elections office. 37

  38. Additional InformationNVRA Training – SOS Who May Register? Any Person who is: At least 18 years old If a person is not yet 18 but will turn 18 by the next election, the person may register any time during the two months (60 days) before the election. ORS 247.015(2) 38

Any Person who is: A United States Citizen If a person is not yet a United States citizen but will be by Election Day, the person may register to vote. However, the person must contact their county elections office to obtain the procedures pertaining to this type of a situation. If a person is not a U.S. citizen, there is no need to offer an opportunity to register. 39

  40. Additional InformationNVRA Training – SOS What Is the Deadline to Register? The voter registration card must contain either a date stamp, or a postmark, that is at least 21 days prior to the first election in which the registrant would like to vote. Once registered in a county, voters may update their registrations (change address, name, etc.) at any time. Four elections are scheduled each year, not including special elections. However, not every county will conduct an election on each of these dates. County elections officials will notify the agency sites in their counties of registration deadlines as necessary. 40

Additional InformationNVRA Training – SOS • 6 Points To Remember • NVRA requires agencies to provide clients the opportunity to register to vote with each application, renewal, recertification or notification of address or name change • Review the completed voter registration form for accuracy and legibility. • Date stamp the completed form. • Detach and retain the completed declination formfor 24 months. • Submit the voter registration card to county elections within 5 days of receipt. • Report to the Secretary of State the number of voter registration cards submitted to the county. 41
