  3. What is a Federal Supply Schedule? • Government-wide contract vehicle for commercial products, services, and solutions • Also known as Schedules and Multiple Award Schedules (MAS) • Statutory Authority: Section 201, Federal Property and Administrative Services Act of 1949

Schedule Facts • Over 11 million supplies and services • 35 open and standing solicitations published on FedBizOps • Over 18,000 Schedule contracts (80% are small businesses) • Over 15,000 small businesses • Woman-owned small: 3,800 • Veteran-owned small: 2,500 • Service Disabled Veteran Owned Small: 1,000 • Small Disadvantaged: 2,300 • 8A: 1,600 • HubZone: 600

Who can use a Schedule? • Federal agencies and activities of the executive, legislative and judicial branches; • Government contractors authorized in writing by a federal agency pursuant to 48 CFR 51.1; • Mixed ownership government corporations (as defined in the Government Corporation Control Act); • The government of the District of Columbia; • State and Local Governments as authorized by Congress; and • Other activities and organizations per GSA Order ADM 4800.2E, Eligibility to Use GSA Sources of Supply and Services

  6. Why Use a Schedule • Compliance with competition, environmental, socio- economic requirements (applies to agency SBA goals); • Variety and availability of sources; • Electronic systems; • Discounts are within the negotiated pricing; and • Reduced acquisition lead time

  7. Award of the Schedule Base Contract • FAR Parts 38 and 12; • Acquisition Planning; • FedBizOps; • Responsibility determinations; • Terms and Conditions; and • Fair and reasonable pricing.

  8. Schedule Ordering ProceduresFAR 8.4 • Orders not requiring a Statement of Work (SOW) • Orders requiring a Statement of Work • American Recovery and Reinvestment Act of 2009 (ARRA) • DoD Section 803 Ordering Procedures

  9. Schedule Ordering Procedures, cont. KEY POLICIES and CONCEPTS • Five year base contract + 3 five year Options; • Acquisition Planning (Far Part 7); • Price Reductions; • Micro-purchase Threshold; and • Maximum Order

Orders Not Requiring a SOW FAR 8.405-1 • Up until micro-purchase – place order directly • Micro-purchase to Maximum Order – review at least three Schedule contracts (DoD – See Section 803 Ordering Procedures) • Above Maximum Order – “shall” seek a price reduction “Price reductions may be sought at any time”(FAR Subpart 8.405-1)

Orders Requiring an SOW FAR Part 8.405-2 • Request for Quote (RFQ) • Up until micro-purchase – place order directly • Micro-purchase to Maximum Order – provide to at least three Schedule contractors (DoD – See Section 803 Ordering Procedures) • Above Maximum Order – • Provide to more contractors • Seek price reductions eBuy meets the fair notice requirements “Price reductions may be sought at any time”(FAR Subpart 8.405-1)

  12. American Recovery and Reinvestment Act of 2009 (ARRA) • Notices of proposed orders over $25,000 (even under BPAs) must be synopsized (FAR 7.704) • Award notices for MAS orders (even under BPAs) shall follow the procedures in FAR 7.705

DoD Section 803 Ordering Procedures • DFARS 208.405-70 • Orders exceeding $100,000 - Provide fair notice to as many contractors as is practical • Receive offers from at least 3 contractors; • Reasonable efforts to identify qualified contractors; and • Ensure all offers received are fairly considered eBuy meets the fair notice requirements

Blanket Purchase Agreements (BPAs) FAR Part 8.405-3 Benefits: • Opportunity to negotiate improved discounts; • Satisfy recurring requirements; • Leverage agency requirements; • Quicker turnaround on orders; Awarding and Fair Notice Requirements for Orders Against: • Single Award • Multiple Award

  15. BPAs, cont. “GSA Schedule BPAs give agencies a way to more effectively leverage their buying power for recurring requirements. Contractor Team Arrangements • Arrangement between two or more Schedule contractors to meet customer requirements; • NOT a prime / subcontractor relationship; • Satisfies the customer with a single turnkey solution; • Maximizes use of one or more Schedule offerings; and • Allows for opportunities for small businesses

Which Purchases Must Be Green? • Purchase card/fleet card purchases • Simplified acquisitions (<$100,000), as available • Acquisitions above simplified acquisitions threshold (>$100,000) • Support services contracts • Detailed scopes of work or performance-based contracting • Blanket Purchase Agreements • Purchase from mandatory sources

Electronic Tools Schedules eLibrary : Is the official online source for complete GSA and VA Schedules and GWACs. eBUY: Is an online RFQ system that allows ordering activities to obtain quotes and issue orders. GSA Advantage! An online shopping service through which ordering activities may place orders against the Schedules.

  21. Common Schedule Myths • We can’t use it • You can’t add Terms & Conditions • You can’t seek price reductions • Posting to e-Buy will generate hundreds of quotes
