The ACT • Enacted by President Clinton , October 1, 1996 • Purpose: Encourage donation of food and grocery products to non-profit organizations for distribution to individuals in need • This law: • * Protects you from liability • * Protects you from civil and criminal liability • * Standardizes donor liability exposure • * Sets a floor of "gross negligence" or intentional misconduct for persons who donate grocery products • * Gross negligence - voluntary and conscious conduct by a person with knowledge (at the time of conduct) that the conductis likely to be harmful to the health or well-being of another person 6

FOOD LEFTOVERS Clause • COMPANY would like to donate all leftovers to local charity. The Bill Emerson Good Samaritan Food Donation Act protects donors from liability when donating to a non-profit organization. It protects donors from civil and criminal liability should the product donated in good faith later cause harm to the needy recipient. It standardizes donor liability exposure. FOOD Donation Clause • FOOD DONATION • Should COMPANY not meet the minimum requirement for food and beverage, COMPANY will purchase food from the hotel in the amount of the unused food and beverage minimum and donate it to a local charity. • COMPANY shall take a tax deduction from the chosen food bank. 12
