  2. What is a Customs broker? Customs brokers are private people, partnerships, associations, or corporations who are licensed, regulated, and enabled by US Customs and Border Protection (CBP) to help importers and exporters in complying with Federal import and export regulations. Brokers charge their clients a fee for submitting relevant information and making appropriate payments to CBP on their behalf

  3. “Customs business” refers to transactions with CBP involving merchandise entry and admissibility, classification and valuation, payment of duties, taxes, or other charges assessed or collected by CBP on merchandise as a result of its importation, and refund, rebate, or drawback of those duties, taxes, or other charges. “Customs business” also includes the preparation, and activities related to the preparation, of documents in any format, as well as the electronic transmission of documents and parts of documents intended to be filed with CBP in the course of any other customs business activity, whether or not the preparer signs or files the documents.

If it is demonstrated to the satisfaction of the port director that the person intends to transact customs business within that district and the person otherwise complies with the requirements, each person granted a broker's licence will be issued a permit for the district in which the port through which the licence was delivered to the licensee is located. A licenced broker will be needed to get a separate permit for any other area in which he or she performs customs business, with few limitations.

  5. The majority of customs business is conducted through company entities. A partnership must have at least one member who is a broker in order to be eligible for a broker's license. An association or corporation must be authorized to transact customs business as a broker under its articles of association or articles of incorporation, and have at least one officer who is a broker to qualify for a broker's licence.
