The US Constitution :all US laws are based upon. The Constitution is the reason that we have the right to privacy, the right to a trial with a jury of our peers, and many other freedoms. • Created September 17, 1787 • The Constitution has been amended twenty-seven times; the first ten amendments are known as the Bill of Rights.
Bill of Rights • All about individuals rights: freedom of speech, religion, bear arms, fair trials etc. Gives power to individual states to create laws. • How does this affect health care? • Tons of laws in healthcare: • Employee Retirement Income Security Act of 1974 (ERISA) • Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA), • The Health Insurance Portability and Accountability Act (HIPAA), • Newborns' and Mothers' Health Protection Act (Newborns' Act) • Mental Health Parity Act (MHPA) • Women's Health and Cancer Rights Act (WHCRA) • Laws how care is given, licensing for practitioners etc.
