Objective 6.1Define the terms associated with landscaping contracting • Client: the person(s) or organization that owns and provides financing for a project. • Contractor:a Party in contract with the client or the clients representatives. • General contractor: directly responsible to the client.

  3. Subcontractor: are in contract with prime or general contractor. • Estimator: provides an estimates of all the cost associated with a project. • Take-off: the calculation of quantities from plans and specifications.

  4. Objective 6.2 Calculations needed for landscapetake-offs • Linear and surface area measurements • Volume measurements • Time calculations • Quantity calculations • Soil compaction calculations • Pit and ball calculations

  5. Objective 6.3 List the components of a contract 1. Names and addresses of the parties involved. 2. Dates of contract preparation. 3. Description of the work to be accomplished and the materials or services to be provided, including the location where it is to be accomplished.

  6. 4. The terms of completion, including such things as inspection, the completion date, and the penalty for not completing on time. 5. The terms of payment. 6. The signatures of both parties or their legal representatives. 7. The date of signing.

Objective 6.4 List and explain how contractors are selected • Direct solicitation of clients • Selection by the client for noncompetitive reasons. • Selection by the client through competitive bidding process. • Advantages: • ID those firms that are not financially astute, since their bids are likely to be significantly higher or lower than the majority.

  8. Allows the client to get a real market valve. • Disadvantages: • May limit the number of firms able to do the job. • The bidder may not have the expertise or financial security needed to complete the project after the contract is signed.

  9. All bidders must spend time working on the bid and lose valve time and resources when they do not get the bid.

  10. Objective 6.5 Describe the documents that may be part of construction contracts. • Standard form of agreement: a document that binds the principal parties of a contract. The form is acceptable to all parties because it has been used for post contracts and the possibilities of misunderstandings are reduced.

  11. Invitation to bid: an advertisement to all interested members of the construction industry that a project is seeking a builder. • Drawing and specifications: The illustrations and written descriptions that describe the project in finite details.

  12. Bid form: a standardized form used for submission of bids, permitting all bidders to be treated equally. • Non collusion affidavit:document assuring that bidders have not discussed the project prior to bidding and established a minimum bid among themselves.

  13. Bid bond: a required security deposit to guarantee that the selected bidder will honor his/her bid. • Performance bond: provides monetary security to the owner of a project if a contractor defaults after the project has started. • Subcontract: confirms the contractual relationship between the subcontractor and the prime contractor.

  14. Notice to proceed: It is a written notice sent by the owner to the contractor, directing the contractor to begin work on the project. • Change Order: provides for changes to the original contract once all parties have agreed upon the change.
