Overview • In the list of Union legislation published before 1st January 2011 the relevant acquis is listed in Chapters 6, 7, 8, 9, 11 and 13 of Title 4 – Food Safety Rules. • The acquis is listed as Basic Text(s) and Application Text(s) • This presentation will start with the legal framework in Iceland and secondly focus on the implementation of the relevant EU legislation

  3. Legal framework • The legislation is EEA relevant • Most of the legislation has been implemented in Iceland • The legislation is implemented according to the provisions of the Icelandic Food Act No 93/1995 • There is some backlog of EU legislation relevant to the EEA Agreement waiting to be incorporated into the Agreement or waiting to be implemented in Iceland

Basic texts – Regulations (IS) No 398/2008 and 568/2008 • Legislation on food contact materials – Chapter 6 • The first Regulation implements Regulation 1935/2004/EC on materials and articles in contact with food • The second act implements Regulation (EC) No 2023/2006 on GMP for materials and articles • This covers the Basic texts

  5. Application texts – Regulation (IS) No 111/203 • Implements Directives on plastic materials • Directive 82/711/EEC on migration testing • Directive 85/572/EEC on simulants • Directive 2002/72/EC relating to plastic materials and articles intended to come into contact with foodstuffs

  6. Application texts – Regulations (IS) No 439/2006 and No 34/2009 • The first implements Directive 84/500/EEC on ceramic articles • The second implements Directive 2007/42/EC on regenerated cellulose films

  7. Application texts – Regulation (IS) No 538/1993 • Implements Directives on individual substances – vinyl chloride • Directive 78/142/EEC on vinyl chloride monomer in materials and articles • Directive 80/766/EEC on analysis of vinyl chloride monomer in materials and articles • Directive 81/432/EEC on analysis of vinyl chloride monomer released by M&A

  8. Application texts – Regulations (IS) No 389/1996, 698/2008 and 838/2010 • The first act implements Directive 93/11/EEC on nitrosamines etc. • The second act implements Regulation No (EC) 1895/2005 on epoxy derivatives • The last implements Regulation (EC) No 450/2009 on active and intelligent M&A

  9. Materials and articles • The implementation is complete • One new act, Decision 2010/169/EU, Union list of additives, not yet implemented and no such obligation Next item: Chapter 7, Food supplements

  10. Food Supplements – Regulations (IS) No 624/2004 and No 327/2007 • The first act implements Directive 2002/46/EC on food supplements, as amended by Directive 2006/37/EC • The second act implements Directive 1925/2006 on vitamins and minerals • The implementation is complete Next item: Chapter 8, Food for particular nutritional uses (FPNU)

FPNU – Basic text Regulation (IS) No 865/2010 • Implements Directive 2009/39/EC, FPNU • Other acts on FPNU are application texts and have been implemented, except for one Regulation which is being translated (Regulation (EC) No 41/2009 on gluten, composition and labelling) Next item: Chapter 9, Quick frozen foods

Quick frozen foodstuffs • The Basic text is Directive 89/108/EEC which is implemented by Regulation (IS) No 557/1993 • The application texts are Directive 92/2/EEC on sampling and analysis and Regulation (EC) No 37/2005 on the monitoring of temperatures, which have been implemented by Regulations (IS) No 557/1993 and 1183/2007. Impl. is compl.

  13. Novel foods – Chapter 11 • Draft Joint Committee Decision (JCD) for incorporation of the legislation into the EEA Agreement has been discussed for several years • No result and consequently no implementation of the relevant legislation in Iceland Next item: Chapter 13, Mineral waters

  14. Mineral waters – Chapter 13 • Previous EC legislation is still in force • New EC legislation partly implemented • Basic text, Directive 2009/54/EC in translation at final stage • Application texts, Directive 2003/40/EC implemented by Regulations (IS) 405/2002 and 1079/2004, while Regulation (EU) No 115/2010 has not been incorporated into the EEA Agreement

  15. Conclusions • Legislation in Title 4, Chapters 6, 7, 8, 9, 11 and 13 has been implemented, with minor excemptions • Legislation on Novel Foods is the only Chapter where no acts have been incorporated into the EEA Agreement and consequently not implemented in Iceland
