    1. *START HERE: TERMINATION OF MARRIAGE The Parts and Processes in obtaining a divorce Montgomery County Pennsylvania

    2. FUNDAMENTAL AGREEMENT When both spouses agree that a divorce should be granted. Before the Court could grant divorce, The following must be met: 90 days have elapsed since the filing of the complaint. Outstanding controversies are resolved (bifurcation is disfavored, meaning that a divorce will likely not be granted prior to resolution of all issues) i.e., child support, child custody, equitable distribution, spousal support/alimony pendente lite, and or alimony after the divorce.

    3. DISAGREEMENT when both spouses do not agree that a divorce should be granted. Before the Court could grant divorce, The following must be met: Two years have elapsed since the filing of the divorce complaint, or establishment of fault grounds. AND All outstanding controversies have been resolved.

    4. Determination of Child Custody First step, Both parents attend child custody seminar Custody Conciliator hears case, seeks an agreement and or makes a recommendation to the Court. Either party may reject Conciliators recommendation and case will be heard and decided by a judge.

    5. Equitable Distribution/ Division of Marital Assets Master of ED, hears case and makes recommendation to Court, grounds for divorce must be established prior to issuance of a hearing before the Master. Either party may reject Masters decision and case will be heard and decided by a judge.

    6. Child Support Spousal Support/Alimony Pendent Lite Department of Domestic Relations reviews case and will determine an amount payable. Either party can reject decision and seek review of case by Master of Support. Either party can reject decision and seek review of case by judge.

    7. POSSIBLE SHORTCUT Agreement by spouses regarding all issues, settlement agreement signed and submitted to court to become part of the divorce decree. TIME CONSUMING ACTIVITIES Exchange of financial information between spouses. Expert opinions regarding the child custody.
