  3. Open Proceedings/Equal Treatment Most court proceedings are open to the public Which proceedings do you think aren’t made public? Judges must be impartial
  4. Types of Cases Supreme Court Appellate Division Superior Court/Trial Court Criminal, civil and family law Tax Court/Municipal Court
  5. Criminal Cases Serious crime Robbery, theft, drug possession, murder Prosecutor; Defense Attorney; Judge; Jury Jury consists of 12 citizens Community people Hear the evidence from witnesses who testify Unanimous vote What if the jurors are unable to decide???
  6. Plea Bargaining Many, many, many cases are decided by plea bargaining. What is plea bargaining? Does the judge have to agree with it? When can it happen?
  7. Civil Cases Plaintiff claims injury by actions of defendant Body, property, reputation, rights Plaintiff is seeking money Car accidents, age, race, gender discrimination, medical malpractice, landlord/tenant 6 members on the jury General Equity cases: what are they? Who are they decided by? How else can parties settle their disputes?
  8. Family Cases Civil Involve children, spouses, domestic partners Divorce, adoption, juvenile delinquency, child abuse, child support, domestic violence Closed to the public…why?
  9. Appeals Court: If you don’t agree with the outcome of your case, you can appeal!!! Appellate Division: No juries No witnesses No new evidence 2 or 3 judges Supreme Court: If you’re unhappy in the Appellate Division, you can take it to the Supreme Court. 6 Associate Justices and 1 Chief Justice Same rules as Appellate Division
  10. Municipal Court Most of the cases filed in NJ courts are heard here Motor vehicle offenses like illegal parking, speeding, driving while intoxicated Also simple assault, trespassing, shoplifting These are known as Disorderly Person offenses
  11. Jury Duty-$$$$5 a day!!! Petit Jury: 12 jurors in criminal; 6 in civil Grand Jury: Decides whether there is enough evidence for a person to be brought to trial for a crime Most criminal cases begin with a decision by a grand jury to indict a defendant (official written accusation charging someone with a crime) 23 people meeting once a week for 16 weeks Proceedings are NOT open to the public
  12. Probation Given to first time offenders who are convicted of non-violent crimes Payment of fine Restitution Seek counseling for substance abuse Community-service work Different from parole
