  2. When does an ELAC Committee need to be established?

  3. When there are 21 or more English learners at a school there shall be a functioning ELAC. EC 62002.5;5 CCR 4312

  4. ELAC Responsibilities • Advise the principal and the SSC on: • The development or revision of the Single School Plan for Student Achievement with the programs and services for the English learners. Assist the school principal and staff on: • The school’s needs assessment. • The school’s annual language census (R-30 LC Report). • Efforts to make parents aware of the importance of regular school attendance.

  5. ELAC: Essential Criteria On the committee, the percentage of parents of English learners is to be at least the same as that of English learners at the school. Parents or guardians of English learners elect parent members of the school committee or subcommittee. All parents shall be provided the opportunity to vote for committee members. The committee shall have the opportunity to elect at least one parent member to the DELAC.

  6. ELAC: Essential Criteria • Receives continuous training to help parents carry out their responsibilities. • The committee receives appropriate information and materials to allow members to carry out their required legal responsibilities. • After forming, training, and electing a DELAC representative, the ELAC members may delegate their legal responsibilities to another existing school committee. 7. The training is always planned in full consultation with ELAC members.

ELAC: Requirements of SB 355 • California ED Code/Section 35147-(SB 355 Greene) • Meetings must be open to the public and allow for public input. • Meeting notice and agenda must be posted at least 72 hours before the meeting. • Notice and agenda must be posted at the school site or other appropriate place accessible to the public.

Requisitos del ELAC: SB 355 • Notice and agenda must include date, time, and location of meeting and the items to be discussed or acted upon. • Action cannot be taken on items not posted on agenda, UNLESS an unanimous vote finds a need for immediate action. • The public must be provided access to all materials discussed and/or distributed at the meeting.

  9. Characteristics of an Effective ELAC Has clear understanding of ELAC purpose and functions. Meets on a regular basis. Plans ahead. Communicates with principal, staff, SSC and school community. Develops by-laws, agendas and minutes.

  10. ELAC Benefits It is a means for receiving training. It is a means for receiving information on programs and their effectiveness. It is a way for parents to participate. It is a way to become aware of student academic progress. It a way to make key questions regarding education themes and issues. It is a way exercise leadership before the principal, school staff and students.

  11. When does a DELAC Committee need to be established?

  12. When there are 51 or more English learners at a school district there shall be a functioning DELAC.

  13. DELAC Responsibilities Advise the district governing board (in person and/or in writing) on the following: • Development or revision of a district master plan of education programs and services for English learners, taking into consideration the Single School Plans for Student Achievement.

  14. DELAC Responsibilities • Conducting a district-wide needs assessment on a school-by-school basis.

  15. DELAC Responsibilities • Establishment of district program, goals, and objectives for programs and services for English learners (e.g., parental exception waivers and funding).

  16. DELAC Responsibilities • Development of a plan to ensure compliance with any applicable teacher and instructional aide requirements.

  17. DELAC Responsibilities • Administration of the annual language census (R-30 LC Reports) (e.g., procedures and forms.)

  18. DELAC Responsibilities • Review and comment on the district reclassification procedures.

  19. DELAC Responsibilities • Review and comment on the written notifications required to be sent to parents and guardians pursuant to Education Code Section 48985 and Title 5, CCR, Subchapter 4, Section 11316.

  20. DELAC Responsibilities • Any waiver request affecting programs and services for English learners.

Essential DELAC Criteria • Parents or guardians of English learners not employed by the district must constitute a majority membership of the committee. • Each school English learner advisory committee (ELAC) must have the opportunity to elect at least one parent member to the DELAC. If the district has 31 or more ELACs, it may use a system of proportional or regional representation.

  22. Essential Criterias of DELAC • The committee advises the governing board. • DELAC members receive appropriate training which includes materials to assist each member to carry out his or her required legal responsibilities. • The training is always planned in full consultation with DELAC members.
