  1. Dose of current affairs for your UPSC preparation The previous year's question papers of the UPSC exam signify the importance of current affairs. From universal general knowledge to national events, the current affairs for UPSC has a vast scope. Here, we share a quick review of IAS's current affairs for you. Today, we are focusing on the Federation. After a few incidents, the word "federation" has become very famous. The probability of covering this concept by the syllabus of IAS current affairs is very high. The current events have raised the need to reanalyze our Judiciary system. That's why the federal approach of our judiciary is under the scrutiny of netizens. Understanding Federalism The term signifies an administrative system that comprises the two-phase structure of government. The government bodies are responsible for managing the same territory or the region. Let's understand other features of Indian Federalism. ● The concept of Federalism creates a balance between unitarism and confederalism. The authority point of both concepts stays in the middle power line. ● It is among the fundamental characters of the Indian Constitution. The Supreme court also mentions the same concept during the Kesavananda Bharati case. ● Federalism basically encompasses distribution of power, independence of judiciary system, well-formulated constitution, bi-cameral legislature, and regarding constitution as the final say in matters. ● The centralized state of the Indian federal system is remarked as "quasi-federal" in the opinion of K. C. Where. ● If there is an emergency event, then the central government takes complete control over states' finances. ● There are two essential concepts in the Federation concept- Powers of the Union and Powers of Parliament. ● The federal concept of judiciary includes the dual system of courts. However, the Indian judiciary system has a unified and embarked structure of the courts. The head of this system is designated to the Supreme Court. ● Power of the Union explains the incorporation of central powers in the state governments if there is any dispute or drift. But, on the other hand, the Power of Parliament signifies the authorization of altering the boundaries and recognitions like names of the states. ● So you can draw out the conclusion that the Centre gets more support and action area than states. This resulted in its key coin of "semi-federal" or "quasi-federal." This is also the reason for the demand for a complete federal concept. The Indian Federation works on two political levels, but the limited jurisdiction scope. Both High courts and Supreme courts have one judiciary which draws verdicts on all the cases. The constitution of India also mentions "Equality of Power". This term represents that the supreme court judges and high court judges belong to the same designation level.

  2. However, while drawing the final verdict on a case, the Supreme court has shown its superiority in many events by contradicting the High court verdict. The time of Emergency makes a good instance for representing the balance in power. The Supreme Court failed to maintain the peace in Emergency times, so the High court came as a leading guiding light of the nation. Trends of "Power Imbalance" The concept of Collegium hovers on the bias-free balanced working of the Indian jurisdiction. It allows the Supreme Court to designate the post of Supreme court judges and High court Judges. It vastly affects the power dynamic of the jurisdiction hierarchy. Next comes Parallel Judicial Systems, which confers the governments to make laws. This gives birth to various parallel judicial arrangements. Such parallel judicial systems go under the direct authority of the Supreme court, dodging the High court. Last but not least, the queue of petty cases. The Supreme court has given quite a lot of time to trifling cases. Like in 2018, the Supreme court verdict that Deepawali can only be celebrated for 120 minutes in the evening. This hampered the religious beliefs of many people. For instance, South Indians celebrate Diwali in the morning. So the verdict faced a lot of backlash and opposition from South India. Conclusion Both the bodies are crucial for making the system streamlined. The power balance requires the empowerment of High courts again. This will help recreate the verdicts and moves of the Supreme court, which may not be in people's best interest. Therefore, the concept of Federation is of great importance in current affairs for UPSC.
