ABOUT THE PRACTICE AIM OF THE PRACTICE • is to able to understand the agents in liner shipping • is to learn the documents used in the liner shipping agents’ organizations STEPS OF THE PRACTICE • To give a summary about the liner shipping agencies • To understand the steps in which the liner-shipping agency follows in the organization AS AN INTERPRATATION • To learn about the documentation system in the agents • To follow the process of agency documentation.

  3. SHIP’S AGENT The ship’s agent represents the shipowner/ master at a particular seaport either on a permanent or temporary basis. This includes: • notification of arrival and departure of the vessel; • acceptance of vessel for loading, discharge, repairsand storing ; • arranging berths, tugs, harbour pilots; • ordering stevedores, cranes, equipment, etc; and so on.

SHIP’S AGENT ‘In port’ requirements include: • the needs of the Master embracing bunkers stores, • provisions, • crew mail and wages, • cash, laundry, engine and deck repairs, and crew repatriation; • completion of customs, immigration and port health formalities; hatch and cargo surveys; • collection of freight; • collection of issuing of Bill of Lading; • completion of manifests, Notarial and Consular protests, and so on.

  10. DOCUMENTS • Bills of Lading (B/L) : In most international sales transactions the goods are to be carried by sea, the seller of the goods promises to do two things: • Put the goods on board a ship • Provide the commercial documents required by the contract, the central one usually the B/L.

  11. DOCUMENTS The B/L says a lot of things to those who come into possession of it: • It helps to identify the owner of the goods – in this respect it is a document • It identifies the party who can receive the goods – again as a document of title • It is a means of transferring title from one person to another

It provides information on: • - the description of goods • –the condition of goods • –the quantity of goods • –the loading port and date of shipment • –the discharge port • –the name of ship • –whether freight has been paid • –the terms of carriage under which the cargo is being carried • –delivery instructions (eg. The notify or consignee)

  13. DOCUMENTS • In this respect the B/L is both a receipt for the goods shipped and evidence of the contract of carriage. • Failure to ensure accuracy can give rise to liability of the shipowner.

  14. DOCUMENTS • Clean bills of lading: is one which do not cast doubt on the condition of the time of shipment. In order to issue a clean bill of lading a master not have to say that the goods are in good condition. It is sufficient for him to say that they are in apparent good order and condition. A clean bill of lading is simply saying that the external appearance of the goods and/or packaging is good.

  15. DOCUMENTS • Claused bills of lading: a clean bill of lading can be issued when the master has no reason to doubt the apparent good and condition of the cargo when shipped. If he does have doubt about it, then he should issue a ‘claused’ bill of lading (sometimes called a ‘foul’ or a ‘dirty’ bill of lading). Such a bill of lading may not be acceptable to the buyer or may not be capable of passing through the finance or letter of credit arrangements which have been made for the sale contract. This is essentially the shipper’s problem as discussed below.

  17. Short Form Bill of Lading • A Bill of Lading where an abbreviated version of contract clauses – or reference to such clauses- has been printed on the back. • Often referred to as common short form Bill of Lading.

  19. Delivery Orderözet beyan - ordino • A written authority to deliver goods etc. To a named party in exchange for the bill of lading usually at the port of destination. It is used at the port of destination and is subject to all the terms and conditions of the carrier’s bill of lading.

  20. Delivery Order • It must not contain any reservations or clauses other than those appearing in the bill of lading except where increased obligations or extra cost may be incurred in giving delivery beyond the bill of lading. The document is issued at the port of destination in exchange for an original bill of lading and legally is recognized as a taken of an authority to receive possession.

  21. Manifest -özet beyan • A summary of cargo loaded on a ship. This would include its weight measurement, freight details and total amount- whether prepaid or payable at the destination, port departure and destination; nature of cargo and so on. Such a manifest is usually termed a freight manifest. • Cargo manifest (it includes only the details of the cargo) • Freight manifest(it includes the freight details paid or payable at destination)

  22. Shipping Note • A documentation provided by the shipper or his agent\ freight forwarder to the berth operator and\ or shipping company giving information about export consignments offered for shipment. It is a delivery or receipt note.
