On the IRS website you can find a copy of the Taxpayer Bill of Rights. What is the most interesting is these “Rights” are rarely adhered to, thus reducing them to empty words. As a part of this Bill of Rights is the “Right to be Informed.” This never ends up being the case. Routine responses to tax returns they don’t like are handled by mailing “taxpayers” the infamous 3176C or “frivolous filing” letter. These letters are almost always in blatant violation of this supposed right, as they never specifically define or identify what erroneous or incorrect entry was made on the tax return leaving the taxpayer to guess what they did wrong.
Instead, the taxpayer is told that he must withdraw the return or face a $5,000 fine. No explanation or alternatives are given. A further look into the Internal Revenue Manual (IRM) shows that the taxpayer also has the option of sending a declaration disputing the frivolous filing letter. When these computer generated letters from tax agencies are received they almost always creates a flight or fight response in people, causing fear and panic, which is the intended emotion they seek to invoke by their use. Because of fear most people rush to get in compliance and avoid any issue with the “Big Bad” taxing agency.
In the IRS’s manual regarding the Right to be informed it states: “They [taxpayers] are entitled to clear explanations of the laws and IRS procedures in all tax forms, instructions, publications, notices, and correspondence.” The 3176 letter is at best vague as it fails to identify any specific entry on a tax return they allege is faulty. This is a clear violation of this Right. ANSWER: NEVER. They will quickly tell you if you underpaid however and send threatening letters like the frivolous filing letter telling you that your only option is to voluntarily withdraw your tax return if it does not fit into their “normal standard” format they are used to seeing.
Your return could be 100% accurate, correct and in full compliance with the law, but if the return is out of the norm, you will almost invariably receive a threatening letter telling you a $5,000 fine will be imposed against you if you don’t withdraw it. What has been seen time and time again is that you must be able to establish how much you owe and also be determined to follow through with your position to the end. The federal tax laws are intentionally deceptive, long and confusing because they do not want people to understand it. They want you to be confused so you will submit and just pay taxes you don’t owe.
Isn’t this a wonderful government we have. Court rulings are intentionally deceptive and follow no commonality, unless you stick only to U.S. Supreme Court rulings. The federal tax code, is as it implies by its name a code that applies to federal activities, employment and certain federal benefits. If you do not partake of any of these things, you don’t owe the tax and it is just that simple. The Federal taxing agency is a big, ugly, unforgiving machine and it swallows a lot of people and families whole. The saddest part is this happens and it happens a lot more than you might imagine EVEN WHEN THOSE PEOPLE DO NOT LAWFULLY OWE 1 PENNY IN TAXES.
It’s a bad system run by people who only care about extracting as much money as they possibly can from everyone, regardless whether you owe the tax or not. The U.S. Congress has no interest in fixing it either.
