  2. LMany people believe that they can plan their estate on their own, without a lawyer. There are even websites where you can print off a will and customize it to fit your needs and wishes, making it seem like you don’t need to get anyone else involved (or even pay a lawyer). Some people even try to bypass a lawyer after a person has passed away. They try to read the will and do what is asked, without spending the extra money. They think that it should be simple enough that they don’t need to hire a lawyer to help.

  3. That being said, it is always a good idea to talk to a lawyer when you are planning your estate. You also should consult with one when you are going through the administration of someone’s estate who has recently passed away. Just because you feel like you don’t need one, it doesn’t hurt to make sure. Here are some best-case scenarios where a lawyer should still be consulted for estate planning.

The family is all on good terms According to Frederic Giersch, though most people only think that they need to have a lawyer when the family is fighting over an estate, the truth is that it doesn’t hurt to have one even when everyone is on good terms. When a wills terms become clear to everyone, there are times when even the closest of families get upset over the wishes of their loved ones. They may want to contest the will because they don’t feel like it is fair for everyone.

You have discussed your wishes with your affected family and friends so that there are no apparent issues. You have taken into account everyone’s feelings. You have designated certain assets to certain people, so you don’t think that there is going to be anyone who is surprised when your will is read. You don’t see how anyone would contest your will because you have talked about it with everyone.

  6. The wills terms are relatively straightforward For most people, their will and finances are pretty straightforward. They own a house, have a checking and savings account, and some funds for their retirement. They may own a few other things of value, such as art and jewelry. In fact, they may not even have a will because they aren’t worried about it. If they do, they might not go through a lawyer because it seems unnecessary.
