  1. This House believes... ...that the use of vivas to decide cases of academic misconduct is unsafe, unsound and that they should never be used.

  2. FintanCulwin proposing... The viva will only tell you what the student knows on the date of the viva. This will/may have no relation to what they knew when the incident occurred. Any system must give the student due notice of the date and time of the viva and hence time for them to (attempt to) become very familiar with the suspect material and the ideas and concepts it was assessing.

  4. Reason For 2 The viva is assessing a student’s ability to express themselves verbally. In terms of situated learning this is very different from expressing themselves in writing. Hence the viva will only tell you if the student can talk about the ideas and concepts not if they could have written (etc.) about them..

  6. Reason For 3 The viva would be a very stressful experience. Hence the viva will only tell you if the student can express the ideas and concepts under conditions of great sterss, not if they could express them in their own space and time. Furthermore, more assertive students would perform better giving a clear gender and culture bias.

  8. Reason For 4 The viva is essentially a ‘fishing trip’ in an attempt to obtain ‘evidence’ which is otherwise absent. The only clear evidence might be an ‘OK Guv it’s a fair cop! I admit that I cheated!!”, which is most unlikely. The only other clear possible outcome is exoneration. That is a decision that even though the work looks too good the student demonstrated that they were now capable of producing it.
