The Romanian Association of Solid Waste Management (ARS), established in 2000, is: • Legal, non-profit, autonomous, non-governmental, professional and employers' professional body; • The only association in Romania that focuses on activities connected to waste management, its recycling and reuse, according to environmental issues • Partner of Ministry of Environment and Sustainable Development, Ministry of Economy and Trade, National and local Environmental Protection Agencies, local administration, other associations in waste management sector • National Member of ISWA • Affiliate Member of FEAD

The main activities of the Romanian Association of Solid Waste Management: • Providing professional training and specialized consulting services; • Cooperation in the field of waste management, recycling, and environment protection; • Collaboration with similar authorities and organizations in Romania and abroad; • Setting-up symposiums, conferences, seminars and exhibitions; • Publishing information materials resulting from studies and research.

In Romania, the collection of municipal wastes is the municipality responsibility, directly, through specialized departments within the Local Boards, or indirectly - by granting this duty to special sanitation services, on a contract basis. The sanitation services exist and operate mainly in the urban areas. It is estimated that, in 2005, only 7% from the rural population did benefit from these services (mainly the rural localities which are in the proximity of cities).

The private companies cover 64% of the existing sanitation activities in Romania (12,8 millions inhabitants from a total population of 22 millions) and 80% of the private companies are members of ARS. The companies are active in collection, transportation, sorting, recycling and disposal of municipal and assimilative waste.

EUROPEAN LEGAL FRAMEWORK ENVIRONMENTAL LEGISLATION – implemented with clear objectives and targets and transition periods EU legislation on the Waste Management was transposed – 100% by the Romanian National Strategy and National Plan for Waste Management – approved in 2004 – G.D. 1470/2004. DETALIED WASTE MANAGEMENT PLANS FOR 8 REGIONS – December 2007

TRANZITION PERIOD OBJECTIVES AND TARGETS 2009 - Implementation of the selective collection of municipal waste in urban area - 100% 2013 – Recycling of the packaging waste generated volumes with 55% 2013 – closure of 238 existing municipal landfills which are not in compliance with EU regulations and construction of 65 landfill fully in compliance with EU regulations (ELV, WEEE, aso)

ADMINISTRATION SPECIFIC LEGISLATION – in the implementation phase Ex. Starting with 21.03.2007 the Romanian Administration Legal Framework in the field of public services (including sanitation) is represented by the Law 51/2006. Specific for sanitation : - Law 101/2006 – May 2007 - regulations for human settlement sanitation services – August 2007 The Law 101/2007 has been enforced in May 2007 and revised, for the first time, in August 2007. So could be considered that for the moment there is not a legal framework in sanitation and that represent a risk for a fair competition in the waste management in Romania.

COSTS EVALUATION For implementation of the national concept for waste management in Romania, the costs are estimated at 4,340 mill. Euro : • 2,534 mill. Euro – household • 1,296 mill. Euro - assimilative waste • 510 mill. Euro – services management In order to reach all the above mentioned goals, should be as soon as possible implemented in Romania a clear and correct legislation in the administration field.

ARS is a member of FEAD starting with January 2007 and has participated only at 2 meetings (ex. May 2007 – Waste Framework Directive). But, in 2007 during our participation at the working groups at the Ministry of Env. And Sustainable Development we presented the FEAD position on the new Waste Framework Directive. We consider that our association should be more active as an FEAD member and we will do that in the future!
