Prior to the inclusion of market-based compliance mechanisms in regulations, to the extent feasible: Consider potential for direct, indirect and cumulative emission impacts, including localized impacts, in communities already impacted by air pollution Design market-based mechanisms to prevent increase in smog or toxic emissions ( Health and Safety Code §38570(b)) AB 32 & Public Health 3

Establish a public health workgroup of public health agencies and organizations to review and provide input to the staff on proposed greenhouse gas reduction measures Develop a methodology to assess cumulative air pollution impacts of proposed regulations Identify communities already adversely impacted by air pollution before adoption of a cap-and-trade regulation Scoping Plan Board Resolution 4
