  2. Public procurement: what is it? The public sector’s purchase of goods, services and works. An enormous market of several thousand billion GBP and euros a year • 14% of GNP in the EU. • In the UK, local government procurement of goods and services - £40 billion pa Higher value contracts (>£144,371, except works): regulated by EU legislation (EC Procurement Directives), recently updated to incorporate modern business practices and interests.

  3. Why is it regulated? History of the European Internal market: Competition policy to prevent discrimination and to protect suppliers. Need for free movement of commodities, services and capital in European countries. Fundamental principles of equal treatment, transparency and mutual recognition across EU countries

  4. Objectives of the regulations? Provide more value for money Initiate competition to prepare businesses for worldwide competition Develop equal opportunities for businesses selling to public authorities Take into consideration new issues: environment, social enterprises, e-business

  5. The new legislative framework The EC amended the legal framework for public procurement in 2004. The UK implemented the changes in January 2006. Now taking into consideration e-procurement, social responsibility and buying green.

  8. What does this mean for your business? Standard rules across Europe and the UK to sell to public authorities. In theory no discrimination between small and big businesses. More initiatives actually developed to support SMEs, social enterprises and green businesses in Public Procurement.

Where do you find out about Public Procurement opportunities By law, all contracts notices from public authorities have to be advertised in the Official Journals of the EU, as long as: -the contract value is >£144,371 (except works contracts, much higher) - but does not mean that Public authorities will not advertise lower value contracts. Indeed most now do

Difficulties experienced by SMEs Finding and obtaining information on future contracts Lack of knowledge of the tenders procedures (three types of procedures for OJEU contracts – open, restricted, negotiated) Jargon difficult to understand when reading the OJEU notices Short time to prepare the bid – need to be aware when the advert appears

Difficulties experienced by SMEs (2) Small teams, not enough resources dedicated to the project Strict qualifications and required certifications Large size of contracts Financial guarantees required/minimum turn over Perceived discrimination against foreign tenderers/finding good partners abroad.
