Brief description of the Amendment. • No answer for a crime unless legally charged. • Cannot be charged for a crime where the person isn’t guilty and tried again for same crime (Double jeopardy). • Cannot be deprived of life, liberty, and property without due process of law. • Private property cannot be taken unless compensated.
Due process of law (in depth) • Able to have a fair and public trial while being present. • Right to an impartial jury and be heard on own defense. • Laws shall be written in a way where everyone can understand them. • Taxes are for public purposes only. • Property can be taken by government for public purposes but owners must be compensated.
Current Event from PCMAG.COM • April 15, 2010 • Lower Merion School District of Ardmore, PA had a lawsuit filed against them, claiming that the Macbooks that were given to students had pre-installed software, • This software allowed the school district to activate the student’s Macbook webcam at anytime. Even when they were at home. • The school district claimed that it was for security purposes. In case the laptops were reported to be stolen, they can take pictures of the thief.
Current Event Cont. • Carol Cafiero and Michael Prebix were the only two that were authorized to activate the webcams. • Carol refused to answer any questions and cited her 5th Amendment right against self-incrimination. • "Thousands of webcam pictures and screen shots have been taken of numerous other students in their homes, many of which never reported their laptops lost or missing," Haltzman wrote in a motion filed Thursday. • (Haltzman is a reporter)
How it relates • The 5th Amendment protects the witnesses from submitting information that could make them guilty. • Hence the reason we say “Plead the Fifth,” which is refusing to answer any further questions that could make fingers point towards oneself.
