Delivery of Ongoing Mental Health services on School Grounds • Mental health services delivered on school grounds during the instructional day (i.e., does not include short-term visits, interviews, or classroom visitations approved by the principal) • Rationale for contract between the BCSD and the Kern County Mental Health Department (“MHD”) • Criminal background and TB clearance • Delivery of instructional program (e.g., instructional time allocations) • Students/staff more fully benefitting from services • Conduct of psychotherapists and counselors on school campus • Outsiders/visitors receiving services on a campus • Need for service, effectiveness of service, and increasing spread of the benefit

Key Provisions of contract • Individual application to District and certification by MHD of criminal background and TB clearance (individuals apply for each school; must be authorized before services begin) • The MHD will: • obtain written consent for mental health services from a parent, legal guardian, or person with educational rights before delivering services to a District student; and • provide a copy of the executed consent to principal/designee • The District/principal reserves the right to exclude the provision of services to a student during the school day when math, and English-Language Arts, or reading instruction is scheduled

Key Provisions of contract (Continued) • MHD has agreed to evaluate all services delivered to provide relevant information to decision-makers and consumers about program implementation, utility, and acceptability • The MHD has agreed to modify service delivery when the data indicates no improvement and to modify or discontinue services when the data indicates a student’s condition is getting worse as the result of service delivery • MHD personnel will conduct themselves in a professional manner, and their attire and appearance will conform to the accepted District standard

  5. Key Provisions of contract (Continued) • The District may have MHD personnel withdrawn if: • the achievement, progress, adjustment, or health of MHD personnel does not warrant continuation; • the behavior of MHD personnel fails to conform to the applicable regulations or policies of the District; or • MHD personnel conduct or state of health is deemed objectionable or detrimental to the proper administration of the District • The MHD may not use District facilities to provide services to any person: • required to register as a sex offender, • currently on parole (unless the person is a parent of an enrolled student); • whose presence or acts would disrupt the school, students, or employees; would result in damage to property; or would result in the distribution or use of a controlled substance • The MHD has agree to indemnify, defend and hold harmless the District from any and all losses, liabilities, costs, expenses, (and others) directly or indirectly caused by any act, omission, fault, or negligence of the MHD agents
