Pedlars Act 1894 What is a pedlar? s (1) A “pedlar” means any person who goes from place to place in Bermuda, or to other persons’ houses, carrying to sell, or exposing for sale, any goods, wares or merchandise, not the product of Bermuda, or procuring orders for goods, wares, or merchandise immediately to be delivered.

  3. Pedlars Act 1894 This license is to sell imported dry goods only (clothing, shoes, jewelry etc.) Note • It is not forselling food (snow-balls, baked goods or liquor) • It is not for homemade crafts or plants.

  4. Pedlars Act 1894 What is a pedlar’s certificate? A pedlar’s certificate means a certificate granted to the pedlar named. S(2) Acting as a pedlar without a certificate Any person who acts as a pedlar in Bermuda without a pedlar’s certificate commits an offence against this Act. Punishable on summary conviction by fine.

Pedlars Act 1894 Application form S(4)Every application for a pedlar’s certificate shall be in a Form A and shall be signed by the applicant in the presence of the Justice of the Peace (JP) to whom the application is made. Note • The JP must be for your parish of residence. • Must witness your signature • Must sign the bottom of the form in the designated area for the JP. • The names of JPs in your parish can be obtained by contacting Magistrates Court.

Pedlars Act 1894 Certificate of residents S(5) A pedlar’s certificate shall not be issued to any person unless there is endorsed on or annexed to the application therefore a certificate in Form B in the Schedule, signed by not fewer than three residents of the parish in which the applicant lives. Note • The three(3) residents from your parish of residence cannotbe relatives. • Must have known you for at least three(3) years. • Must sign their names at the top of Section B and print their names at the bottom of the same form in the same order.

  9. Pedlars Act 1894 S(6) Pedlar must be over 13 years. S(12) Lending certificate an offence S(13) Borrowing certificate an offence S(14) False certificates - (a) making a false representation to obtain a pedlar’s certificate; (b) forges or counterfeits a pedlar’s certificate; (c) forges or counterfeits an endorsement on a pedlar’s certificate; (d) or aids in making, or procures, to be made forged, counterfeited certificate or endorsement; (e) who travels with, produces, or shows such forged, counterfeited certificate or endorsement, commits an offence against this Act. Punishable on summary conviction by a fine on the first offence and for subsequent offences 6 months imprisonment and/ or fine.

Pedlars Act 1894 Pedlar to produce certificate on demand S(18) Must produce on demand and show pedlar’s certificate to : (a) any JP; (b) any police officer; (c) any person to whom a pedlar offers good for sale; (d) any person whose private grounds or premises a pedlar is found; and any pedlar who refuses on demand to show his pedlar’s certificate to and allow to be read and a copy to be taken by these people commits an offence against the Act. Punishable on summary conviction by fine.

Pedlars Act 1894 Arrest S(19) Pedlar’s refusal to show his pedlar’s certificate, prevention or attempted prevention of inspection of his pack, box, bags etc. by any authorized to do so under the Act, or by anyone acting by his order may be apprehended and brought before a Magistrate to be dealt with. S(20) Any police officer may open and inspect any pack, box, trunk, or case in which a pedlar carries his goods, wares or merchandise. Any pedlar who refuses to allow this or prevents or attempts to prevent the inspection commits an offence against the Act. Punishable on summary conviction by fine.

  12. Additional Information How much does it cost? The cost is $90.00 and covers you for two years. It is payable with the application. Is the process the same for renewals? Yes Where can I get the application forms? The forms can be retrieved from Magistrates Court. Soon to be made available on the Govt. portal under the Ministry of Justice. Can I submit my application via email or fax? No, the original hard copy must be submitted to Magistrates Court with the required fee.

  13. Does this license allow me to sell my goods anywhere in Bermuda? No there are restrictions. CORPORATION OF HAMILTON SELLING WITHIN THE CITY OF HAMILTON Under the Hamilton Traffic & Sidewalks Ordinance 1988 “… It is strictly against the law for anyone, including the holder of a Peddlers’ Licence, to sell or expose goods for sale on any street in the City of Hamilton…” and any person doing so is liable to prosecution under Section 28(f). This also applies to the Towne of St. George.
