Extradition Case: “Court rules against extraditing aboriginal defendants to the U.S.” • September 22 The Globe and Mail Summary: Zachary Leonard and RejeanGionet arrested at a U.S. border crossing in a van carrying various types of drugs. Both are members of different aboriginal nations- Rainy River First Nations and Ginogaming First Nation Justice Minister of Ontario originally ruled to send them to the states for trial (where they could face up to 19 years in jail). The Ontario Court of Appeal (highest in Ontario) ruled that the two should NOT be extradited because of their aboriginal status http://metronews.ca/news/canada/378927/aboriginal-extradition-orders-quashed/

Issues: • US and Canada relations • Aboriginal history and legal issues (both countries) • Affirmative Action- Charter of RF allows for the protection and support of minorities who have been discriminated against in the past • Supreme Court of Canada Precedent Case (Gladue 1999). This case stated that due to dislocation, high unemployment, and systemic racism, there is a highly disproportionate incarceration of aboriginal people

  8. Types of Law/Reasons/Terms • Public Law- Criminal Case- however has reached the Supreme Court of Canada- therefore Public and Constitutional Why did I choose this topic? Terms: Affirmative Action, Extradition, Fundamental Justice- relating to disregard for heritage status, systemic discrimination

  9. Opinion/Significance • Affirmative Action • History • Aboriginal issues in our legal System • Both individuals should not be extradited to the USA. What do you think??????????
