Use of Facilities • Governed by Hawaii Administrative Rules (Chapter 8, Subtitle 2, Part 1) • Chapter 39 – Use of school buildings, facilities, and grounds • Basis for all guidelines and decisions regarding Use of Facilities • This covers all facilities, not just classrooms. • Athletic facilities • Libraries and dining rooms • EXCEPTION – Kitchens

  3. Use of Facilities • Superintendent Memo – 10/25/12 • Clarification to Rules • Highlights • Treat all users equally • Limit period of use to one year or less • BLNR • Uses must be documented • Superintendent Memo – 3/12/13 • Updated Rate Schedules • Clarify daily rates – limit to 8 hours

Use of Facilities – Types of Users • Type I • DOE, school sponsored and school-related activities • Type II • Government agencies, non-profits, clubs, athletic teams, organizations, etc. where no admission charge is made. • Type III • Type II groups listed above who: • Charge participants a fee • Conduct fundraising activities • Do not meet the criteria as a Type I or Type II user

Use of Facilities - FAQ • How do you collect from a user who refuses to pay? • If a school is unable to collect, we recommend contacting the CAS first, then possibly the AG’s office. • Can a person use the kitchen? • Due to liability issues, authorized cafeteria personnel must be present. Please contact the Food Services Branch.

  6. Use of Facilities - FAQ • Can we charge for HSTA meetings? • If it is a sanctioned HSTA event (informational contract meetings, voting, etc.) then no charge. We recommend getting proof such as a letter from HSTA to the Superintendent. If it is not sanctioned, they are usually a Type II user. • What type is a fund raiser for school choir booster club? • The booster club is tied to school related activity, so it is a Type I.

Use of Facilities - FAQ • Should a school deny Use of Facilities if there is no school custodial staff who can work the event? • We recommend that custodial services be available for all uses of facilities. However, there may be exceptions which should be handled on a case-by case basis. • What about giving “regular” users of school facilities access to building/room keys? • Due to security concerns, we recommend against “loaning” or giving users access to building/room keys.

  9. Recent Updates • Facilities working with Superintendent’s office and Attorney General’s office to look at updating and possibly changing policy. • Currently doing research and gathering information to possibly revise Chapter 39.
