Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) BIN 1040750 – Rte. 209 over Rochester Creek • Existing Structure: 1 Span, 44’ long • Structure is on a tangent between curves with a 2.09% grade • Rte. 209 – Rural Principal Arterial, AADT 11,633: Speed Limit 45 MPH • Rochester Creek joins Rondout Creek just east of the structure • Rondout Creek is parallel to the southeast approach roadway. • History of Flooding, including road closure and scour • Existing Structure has a negative Q50 freeboard • Rochester Creek serves as an overflow for Rondout Creek during floods • Rondout Creek is a potential Wild, Scenic & Recreational River • No separate Bike / Ped accommodations – these use shoulders • Utilities mounted on poles along north shoulder of Rte. 209

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) BIN 1019700 – Rte. 28 over Esopus and Birch Creeks • Existing Structure: 15 spans, 1080’ long • Structure is on a curve (R = 3,880 ft.) with a 1.05% grade • Rte. 28: Rural Minor Arterial; AADT 2606; Speed Limit 55 MPH • History of flood scour and debris catchment • History of stream channel(s) shifting following major flood events • Esopus Creek is a potential Wild, Scenic and Recreational River • No separate Bike / Ped accommodations – these use shoulders • Utilities are pole mounted on approaches and 1 carried on the bridge

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Goals • Provide solutions that prevent/reduce flooding frequencies within the project limits that compromise the public’s ability to use the State’s infrastructure. • Ensure the safety of the traveling public; • Deliver the Project safely, on schedule and within budget. • Ensure coordination with utility owners, third parties, the surrounding residential community, Project stakeholders and any adjacent construction projects. • Ensure the Project is compliant with the project’s environmental commitments and conditions.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Goals (continued) • Maximize the impact of the public investment project by: • Providing cost-effective solutions that maximizes value over the lifespan of the PROJECT; • Sequencing construction to minimize effects on vehicular traffic operations; • Reducing future maintenance requirements; • Minimizing effects on residential neighborhoods and business communities; and • Minimizing impacts on the environment. • Provide best value to the Department.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Goals (continued) • For BIN 1040750 (Rte. 209 over Rochester Creek): • It is the Department’s objective to replace this structure with a new structure that will meet the hydraulic requirements of the site, and be compatible with the potential future Wild, Scenic and Recreational River designation of the adjacent Rondout Creek. • In addition, the bridge approach roadways shall be reconstructed to minimize flooding as per Section 18.3.2 of Part 3. • The Department anticipates a replacement structure significantly larger than the existing and highway approach work requiring profile modifications. The extent of these revisions will be determined, in part, by hydraulic analysis of the surrounding area.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Goals (continued • For BIN 1019700 (Rte. 28 over Esopus & Birch Creeks): • It is the Department’s objective to replace this structure with a new structure that will meet the hydraulic requirements of the site, and be compatible with the potential future Wild, Scenic and Recreational River designation of the Esopus Creek. • The new bridge shall minimize the opportunity of debris catchment by reducing the number of piers, preclude undermining of any structural elements by scour, and accommodate the meandering nature of the crossed streams.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) General Scope of Work • Full Bridge Replacement of two bridges (BINs 1040750, 1019700) • Removal of the existing substructures and superstructures • Replacement of the existing bridges including new foundations, substructures, superstructures and approach slabs • Reconstruction of approach roadway necessary to connect existing roadways to the new bridges • Development of a WZTC plan for each site • Coordination with Utility Owners and/or preservation of existing utilities

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Right-of-Way • The Department will own all Right-of-Way needed for the Project by the time of Notice to Proceed • Fee Acquisition and Temporary Easements are in the process of being acquired for: • BIN 1040750 (Route 209 over Rochester Creek) • BIN 1019700 (Route 28 over Esopus Creek) • Acquisition maps are provided in Part 7 – Engineering Data • No additional Right-of-Way acquisitions or temporary easements are anticipated to be required for this Project

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Utility Coordination – Existing Utilities – Relocations by Others BIN 1040750 –Town of Rochester, Route 209 over Rochester Creek • Central Hudson Gas and Electric • Install new utility poles, located along the north side of Route 209, and relocate existing overhead lines to them. • Central Hudson Gas and Electric anticipates eight (8) weeks to perform its work after agreement on a Utility Relocation Plan. • PEG Bandwidth • Relocate existing overhead lines, located along the north side of Route 209, to the new poles set by Central Hudson Gas and Electric. • PEG Bandwidth anticipates four (4) weeks to perform its work after Central Hudson Gas and Electric completes its work.

The utility companies will, at their own expense, relocate their facilities once. If any temporary or subsequent utility relocations are required by the Design-Builder’s solution, these relocations will be at the expense of the Design-Builder.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Utility Coordination • Three Way Coordination – Design-Builder, Utility Co. & Department: • Coordination meeting will be held between the Department, all short-listed firms, and the utility companies before or shortly after issuance of the Final RFP. • Design-Builder Responsibilities: • The Design-Builder is expected to coordinate with any and all affected utility owners and the Department to negotiate and execute 3-Party Final Utility Work Agreements. The Design-Builder is responsible for participating in the negotiations and coordinating the work schedules. • Status of Preliminary Utility Work Agreements: • Signed Preliminary Utility Work Agreements are included in RFP Part 4, Appendix C

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Contract Information • Lump Sum Design-Build Contract • Best Value Selection Process (50% Price, 50% Quality) • Project Completion Date shall be the earlier of: • August 27, 2018 or • The number of days past NTP proposed by the successful Proposer on Form SCD (ITP Appendix E) • Liquidated Damages will be imposed for not meeting the Over-all Project Completion date and/or Interim Completion Milestone dates in excess of the number of calendar days indicated on Form SCD. • Early Completion Bonus will be awarded as per Special Provision 6 if Over-all Project Completion and/or Interim Completion Milestones are achieved in less than the number of calendar days indicated on Form SCD. • Escrow Submission of Bid Documents is required for the successful proposer.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Contract Information • Stipend to Unsuccessful Proposers (50% of Qualified Costs, $137.5K max.) • Must satisfy criteria in ITP General Instructions: • Pass all Pass/Fail Factors • Achieve at least 60 points on Quality Factors • Proposal must be competitive and reasonable • Proposal was not selected by the Department as providing the Best Value • There is a Buy America Clause • There is an Iran Divestment Act Clause • There is a DBE Participation Goal of 11% • Environmental and construction related permits by Design-Builder

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) ATCs • Alternative Technical Concepts (ATCs) are proposals from the Proposers to design and construct the Project in a manner that is different from the Contract Requirements and which: • are submitted to the Department for review, consideration and approval prior to Proposal submittal; • have significant savings in time, and/or reduction of traffic impacts, and/or community disruption, and/or project costs, and/or environmental impacts, and/or other beneficial impacts to Project parameters; and • offer, in the Department’s judgment, an equal or superior Project.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) ATCs • Proposers may submit on a confidential basis any number of ATCs for the Department’s approval using Form ATC. • The proposed end product of each ATC must, in the Department’s judgment, be equal to or better than the Work product described in the Contract Documents. • The Department may provide ‘Conditional Approval’ of an ATC. • The Design-Builder is solely responsible for obtaining approvals from any local municipality, public agency or permit issuing agency for ATC concepts which would affect their facilities, operations or issued permit.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Quality Control (QC) • Quality Control is the Design-Builder’s responsibility. • The Design-Builder shall appoint a QC Manager responsible for QC Plans for both Design and Construction. • Design QC shall be the Design-Builder’s responsibility and shall be performed in accordance with the QC Plan. • The QC Plan is a living document and will be further developed and updated throughout the Project, as described in RFP Part 2. • Construction Inspection shall be performed by an Independent Engineering Firm (hired by the Design-Builder). • Materials Testing shall be performed by an Independent Materials Testing Firm or Laboratory (hired by the Design-Builder). • The Materials Testing Firm shall report to the Construction Inspection Firm.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Quality Assurance (QA) • Design and Construction Quality Assurance is the Department’s responsibility. • The Department may perform QA on any of the Design-Builder’s design and construction activities. • The Department will establish and maintain its own staff, or utilize an independent consultant, to perform QA of the design and/or construction of the Design-Builder’s work. • Offsite plant Quality Assurance will be performed by the Department. • RFP Part 2 describes in detail the Department’s QA role for the Project.

In addition, all Proposers shall comply with the following format requirements: • The inside and outside surfaces of all binders, and both sides of all dividers, shall be solid and shall contain only text; no pictures, renderings or graphics shall be included. • All narrative pages, resumes, Initial Management Plan components and forms shall contain text only and shall contain no pictures, renderings or graphics.

A Proposal may receive a lower score as a result of any pages removed.

Region 8 Bridge Replacements (Ulster County)Design-Build Project (PIN 8BOW.0C; D900034) Question and Answer 1 Paragraph C2.1 titled Key Personnel indicated on page C-1 of Appendix C of the ITP states the following: "The Proposer shall include Form R - Summary Individual's Experience for each of the Key Personnel identified in the ITP Appendix A, outlining his/her experience and qualifications. The content of each Form R that should be filled in includes:....". The listed content that is required does not have designated boxes on the Form R and reads instead like a resume. Resumes are not mentioned in Appendix C's instructions for Volume 2, nor are resumes included on the checklist provided on page C-8. Question: Are resumes required to be provided for the Key Personnel, and if so will they have the same requirements and limitations (i.e. 2 pages) as the RFQ stage? Answer:Resumes should not be included in proposals. The following revised Form R will be included in the Final RFP. This revised Form provides space for the information required in RFP, ITP , Section C2.1.
