  2. About Visa A Bridging visa D (BVD) is a temporary visa that allows an individual to stay in Australia for a short period until they are able to make a substantive visa application or make arrangements to leave from Australia. Bridging visa D Subclass 040 & 041 allows you to stay in Australia lawfully for a short time. It does not allow you to work or re-enter Australia if you leave. There are twotypes of Bridging Visa D: • Bridging (Prospective Applicant) visa (subclass 040) • Bridging (Non-applicant) visa (subclass 041)

  3. Types of Visa Prospective applicant For a non-citizen who is unlawful or will become unlawful within 3 working days and wishes to make a substantive application but is unable to do so. For example, where an incorrect form has been submitted or the correct application charge cannot be paid. In these circumstances, a Bridging visa D is granted for 5 working days to allow a valid application to be made. Non-applicant For an unlawful non-citizen unable or not intending to make a substantive application and an authorised officer is not available to interview them for the purposes of considering their eligibility for a Bridging visa E. In these circumstances, a Bridging visa D is granted for 5 working days within which time the non-citizen must be interviewed at an office of the department or leave Australia.

  4. How long you can stay This is a temporary visa. You can stay for a short time period. A Bridging visa subclass 040 will cease at end of: • five working days after it was granted. A Bridging Visa subclass 041 will cease: • at the end of five working days after it was granted, or • if you are granted a BVE (subclass 050) within those five working days.

  5. Eligibility You can only be granted a Bridging Visa Subclass 040 if all of the following apply to you: • you are in Australia • you do not hold any visa or hold a visa that will end in the next three working days after the day you applied for the BVD • you tried for but unable to apply for a substantive visa. Example, you did not pay the correct charge or you filled out the wrong visa application form – but you will be able to do so within the next five working days (you might then be eligible for a Bridging visa C (BVC).

  6. Eligibility You can only be granted a Bridging Visa Subclass 041 if all of the following apply to you: • you are in Australia • you do not hold a visa • you are either unable to do or not want to apply for a substantive visa • an authorised officer is not available.

  7. Why this visa needed You need a bridging visa to stay in Australia if your substantive visa ends before you aregranted another visa or you are making arrangements to leave Australia. If you are in Australia without a visa, you are an unlawful non-citizen. This can cause problems such as: • you risk being detained and removed from Australia • you might not be granted any other visa for three years after you leave Australia • you might have a debt to the Australian Government for the cost of your removal.
