Web casting vs Broadcasting • Territory • Impossible to define territory for web casts • On-line sales can only be territorially controlled by billing address • Interactivity • Web connected devices are “two way” • Allows content protection at source • Unlimited Channels and Bandwidth • Low investment in programming & production • Little or no public service • No standard web device

  4. There is no single definition for web casting Services differ widely in purpose Massive number of heterogeneous services Scope for web casters to implement security at source Closer to 3rd Party services rather than “communication” of programs

Example Services • Major European radio broadcaster wanted to offer programs on-line in an “archive” • Users can listen to web casts after broadcast • Broadcaster agreed security • All streams protected against ripping and interaction • Broadcaster agreed Usage • Internet connected PCs only • Broadcaster agreed commercial terms

Example Problems • Web casters distribute large number of channels • Each channels provides meta-data about what is being played • The web client allows users to select their favourite songs • The web client “sniffs” each channels meta data to play only the users favourite songs • All programming is lost • The web client behaves as a jukebox

Summary • Web casting is a term that encompasses many business models and consumer offers • No clear definition • Consequently can not be cover by this treaty • No scope for limitation of territory on free to air web casts • Web casting is a 3rd party service • Web casting rights should be negotiation directly with content holders
