  3. ATTENDANCE DEPARTMENT MISSION STATEMENT Our goal is to have every Harlingen Consolidated Independent School District student attend our schools on a daily basis to ensure that they learn their required skills and graduate from high school on their projected graduation date.

  4. HOW MANY ABSENCES ARE TOO MUCH?

  5. CHRONIC ABSENCE IS DEFINED AS 18 DAY A YEAR- OR JUST 2 DAYS A MONTH.

  6. What is Chronic Absence? Chronic absence is missing so much school for any reason that a student is academically at risk. Attendance Works recommends defining it as missing 10% or more of school for any reason. Students who are least six years of age, or who have been previously enrolled in first grade, and who have not yet reached their 19th birthday shall attend school for the entire period the program is offered, unless exempted as indicated below. Students enrolled in prekindergarten or kindergarten shall attend school. A person who voluntarily enrolls in school or voluntarily attends school after the person’s 19th birthday shall attend school each school day for the entire period the program of instruction is offered.

SECTION 25.093 AND SECTION 65.003 OF THE TEXAS COMPULSORY ATTENDANCE LAW AS OUTLINED BELOW: Section: 25.093 of the Texas Education Code, Parent Contributing to Nonattendance: A parent is subject to criminal prosecution for failures to require the child to attend school as required by law, and the child is absent from school on ten or more days or parts of day within a six-month period in the same school year. Section 65.003 of the Texas Family Code, Truant Conduct: If a student fails to attend school without an excuse on ten or more days or parts within six-month period in the same school year, the district shall submit a referral against the student to truancy court.

  12. It is a parent’s duty to monitor the student’s school attendance and require that your child attend school. Failure to do so could result in your prosecution under Education Code 25.093. Education Code 25.093 offense is a Misdemeanor. Under Family Code 65.003, a district may refer a student, ages 12-18 to truancy court for truant conduct which may result in remedial orders by the Judge. The student is subject to truancy prevention measures under Section 25.951 and each day your child remains out of school may constitute a separate offense. Two or more offenses may be consolidated and prosecuted in a single action.

In order to receive credit or a final grade for a class, a student is required to attend class 90 percent of the days class is offered regardless of whether the students absences are excused [see FEA] or unexcused. Atty. Gen. Op. JC-0398 (2001) Except as provided below, a student in any grade level from kindergarten through grade 12 shall not be given credit or a final grade for a class unless the student is in attendance 90 percent of the days the class is offered. This restriction does not affect a student’s right to excused absences to observe religious holy days [see FEA] and does not apply to a student who receives credit by examination for a class as provided by Education Code 28.023. [see EHDC]
