Regulation 13 – Nov 2014 UNECE Regulation 13 5.2.2.2 Trailers of category O2 shall be equipped with a service braking system either of the continuous or semi-continuous or of the inertia (overrun) type. The latter type shall be permitted only for centre axle trailers. Definitions 2.12 "Inertia (or overrun) braking" means braking by utilizing the forces generated by the trailer's moving up on the towing vehicle.   13. Vienna Convention Vienna Convention on Road Traffic 08Nov1968A vehicle is said to be "in international traffic" in the territory of a State if: 1. It is owned by a natural or legal person normally resident outside that State;2. It is not registered in that State; and3. DfT - December 2014 • "Under the European type approval system, and in particular under the General Safety Regulation (GSR), EU Regulation 661/2009, new vehicles and trailers registered after 01 November 2014 will be subject to UNECE Regulation 13 on Braking systems, instead of Directive 71/320/EEC as was the case previously. The Directive has been repealed with effect from the above date. • An A-frame, being neither a vehicle nor a trailer, is not subject to type approval and therefore there is no direct impact on these devices stemming from this legal change. • Legislation in Great Britain recognises the requirements of both Directive 71/320/EEC, and Regulation 13 and, as A-frames fall outside the scope of European type approval requirements, we have no plans to change this flexible approach. • The requirements of Directive 71/320/EEC or UNECE Regulation 13 are applied in the UK by the Road Vehicles (Construction and Use) Regulations 1986. The use of these devices is a matter for national law and countries outside the UK are not obliged to accept the use of these devices in their territory." Logic To Consider - Rationally • UK Registration Authority considered UK Registered Vehicle towing a “Trailer” • Vienna Convention set framework for Member States to have one single open market for Combinations in International Traffic – provided the “trailer” fulfilled the conditions of Chapter III and IV. • Vienna Convention required Member States to admit Combinations in International Traffic to their States for 1 year. • National Law applies to resident National Citizens – and others of course! • Behavioral Law applies to all, but can a National State reclassify a Class of vehicle belonging to another National State? • If one State considers its registered vehicle to be a Class O2 trailer whilst in a certain configuration should other States in a Union respect this sovereignty? • If an EU State disagrees with another registration Authority decision should the EU not challenge that State in the Courts for a ruling rather than impose an arbitrary decision?   19. Driving Licence Rules and what you can tow The rules on what you can tow are different depending on when you passed your driving test. Licences issued from 19 January 2013 From 19 January 2013, drivers passing a category B (car and small vehicle) test can tow: small trailers weighing no more than 750kg a trailer over 750kg as long as the combined weight of the trailer and towing vehicle is no more than 3,500kg Maximum Authorised Mass (MAM) If you want to tow a trailer weighing more than 750kg, when the combined weight of the towing vehicle and trailer is more than 3,500kg, you’ll have to pass a further test and get B+E entitlement on your licence. You’ll then be able to tow trailers up to 3,500kg. Licences held from 1 January 1997 If you passed your driving test after 1 January 1997 and have an ordinary category B (car) licence, you can: drive a vehicle up to 3.5 tonnes or 3,500kg MAM towing a trailer of up to750kg MAM tow a trailer over 750kg MAM as long as the combined weight of the trailer and towing vehicle is no more than 3,500kg For anything heavier you need to take a category B+E driving test. Driving Licence Rules and what you can tow Licences held before 1 January 1997 If you passed your car test before 1 January 1997 you are generally entitled to drive a vehicle and trailer combination up to 8.25 tonnes MAM. This is the weight of a vehicle or trailer including the maximum load that can be carried safely when it’s being used on the road. You also have entitlement to drive a minibus with a trailer over 750kg MAM. Towing heavier combinations If you want to tow heavier combinations, you’ll have to first apply for provisional entitlement to the new C1+E entitlement. You’ll then have to pass the category C theory test and C1+E practical test. Once you’ve done this you can drive vehicles and trailers with a combined weight of up to 12 tonnes MAM. A-Frames & Dollies • A-frames and dollies • If you attach an A-frame to a car in order to tow it with a larger vehicle, the car plus A-frame counts as a trailer. • If you use a dolly to tow a broken-down vehicle, the dolly counts as a trailer. • In both cases the usual safety regulations for trailers apply. • Read more in the ‘A’ frames and dollies’ factsheet. American Caravan/Trailer Brakes and coupling up to 3500kg maximum laden weight • All trailers with a maximum laden weight of 3500kg or less are permitted to have electric brakes regardless of whether they are from America or from somewhere else. Regulations specify that the transmission method by which the signal is used to apply the brakes may be mechanical, hydraulic, pneumatic and, electric. Differences between American caravans and trailers, and European regulations • Operating brakes - It is common on American caravans/trailers with electric brakes to have an electrical device mounted in the towing vehicle which the driver operates manually to apply the brakes of the trailer independent to the brakes on the tow vehicle. This is prohibited in Europe where the regulations demand that the service braking system must be applied without the driver removing his hands from the steering control. • Mounting sensor devices - Alternatively, American caravans/trailers with electric brakes can have an electrical device mounted in the towing vehicle which senses deceleration in the towing vehicle and transmits a signal to the caravan/trailer braking system to operate the brakes. European requirements demand that this type of device must be mounted on the caravan/trailer. • Supply of electricity for electrical braking systems - The electrical energy required for the electrical braking system must be supplied to the trailer by the towing vehicle. If there is a battery on the trailer which is fed by the power supply unit of the towing vehicle, the power from the battery must be disconnected during application of the service braking system. American Caravan/Trailer Brakes and coupling up to 3500kg maximum laden weight • Time delays - Some American caravans/trailers rely on a signal from the towing vehicle stop lamps to initiate braking on the caravans/trailers. Owners of such vehicles need to be aware that the system may not meet the requirement for brake response time. European regulations demand that the time In the case of a semitrailer or centre axle trailer, the maximum mass to be considered for classifying the trailer corresponds to the static vertical load transmitted to the ground by the axle or axles of the semitrailer or centre axle trailer when coupled to the towing vehicle and carrying its maximum load. September2011 delay between the time at which the driver applies the brakes and the time at which the braking force on the least favourably placed axle reaches the level corresponding to the prescribed brake performance must not exceed 0.6 seconds. This could be difficult to achieve on systems that have to wait for the stop lamps to operate before the electronic control unit is activated and the system produces the prescribed brake level. • Parking brakes - American caravans/trailers do not always have a parking brake. European requirements demand that a caravan/trailer must be fitted with a parking brake that is capable of holding the vehicle stationary on an 18 per cent up or down gradient. Also, the working parts must be held in the locked position by a purely mechanical device. • Braking mechanisms - American caravans/trailers do not always have brakes on all wheels, and it is common for a two axle trailer to have brakes on only one axle. This is prohibited in Europe where regulations demand that each individual wheel must brake.
