  2. Oil/Hazmat and ESF #10 What’s the difference? • ESF #10 - Stafford Act activations (FEMA pays) - Fed-to-Fed support (Another Federal agency pays ESF #10 to respond) • Oil/Hazmat Incident Annex - CERCLA/CWA/OPA authority and funding

Oil/Hazmat and ESF #10 Policies • NCP structures and response mechanisms remain in place during an INS, but coordinate with NRP mechanisms • “Nothing in the NRP alters or impedes the ability or authorities of designated Federal officials to carry out their duties under the NCP or to coordinate directly with their agency in execution of these duties.”

  4. Coordination Structures NRP Coordinating Mechanisms and Hazard-Specific NCP Structures (parallel, but not necessarily equivalent) * EPA regional emergency operations are called Regional Response Centers.

  5. Policies: SONS vs. INS • Under NCP, EPA or USCG can classify an oil discharge as a Spill of National Significance • Senior Agency Official (EPA) • National Incident Commander (USCG) • Assist the OSC; assume certain functions • EPA and USCG maintain authority to classify a discharge as a SONS • DHS maintains authority for classifying INS • A SONS may/may not be an INS • DHS may determine that an NCP response that is not a SONS may be an INS

  6. Oil/Hazmat and ESF #10 Annex Leads • Either EPA or USCG are lead for implementing annex for HQ/field response, depending on which has jurisdiction (inland/coastal): - ESF #10 – “Primary Agency” - Oil/Hazmat Annex – “Coordinating Agency” • Lead may be transferred if circumstances dictate

  7. NRP/NCP Regional Level Coordination Regional Response Coordination Center • RRCC coordinates Federal field response until JFO established, then plays support role • When DHS activates RRCC, EPA/USCG provide reps to aid in coordination of regional support efforts

NRP/NCP Regional Level Coordination Joint Field Office • Oil/hazmat + ESF #10 activities expected to operate primarily out of Ops Section (other sections as needed) - EPA/USCG JFO personnel will coordinate with RRT, and EPA/USCG personnel in ICP and, if established, Area Command • EPA/USCG may also need to provide a Senior Federal Official if we play a major role

NRP/NCP Regional Level Coordination Principal Federal Official (PFO) • Does not have directive authority over FCO, SFLEO, or other Federal officials • OSC continues to conduct his/her activities at the ICP using NCP authorities • OSC, SFO and other responding agency reps provide full and prompt cooperation, resources and support to PFO

NRP/NCP Regional Level Coordination EPA/USCG Senior Federal Official (SFO) • For incidents involving major oil/hazmat response, agency providing OSC will likely need to designate an SFO to work in coordination with PFO at JFO (or alternate location if no JFO) • SFO represents annex in JFO • SFO ensures ESF #10 or Oil/Hazmat Annex staffing in JFO units, as needed

  12. NRP/NCP Regional Level Coordination EPA/USCG SFO • In coordination with the OSC, consults the RRT for advice or assistance • Establishes mechanisms for the RRT to coordinate with the JFO • Ensures coordination between the JFO and Area Command, if established

NRP/NCP Regional Level Coordination SFO/PFO Coordination • The SFO coordinates with the PFO on such activities as: • Providing incident information to the PFO • Coordinating public communications strategy with the PFO and DHS Public Affairs • Clearing Federal interagency communications to the public through the PFO

NRP/NCP Regional Level Coordination OSC at ICP • Has authority to direct oil/hazmat response efforts, and coordinate all other efforts at scene of discharge or release • Generally joins ICP already established by local authorities, or • Designates an ICP at the site in accordance with local Area Contingency Plan

NRP/NCP Regional Level Coordination • OSC carries out NCP responsibilities, and coordinates activities with JFO • Typical lines of communication: • OSC with agency SFO and other agency reps at JFO • SFO with PFO and FCO/FRC [Issue being clarified in JFO SOP: Relationship of JFO to ICP/AC] • Existing NRT agency-delegated decisionmaking and contracting authorities remain in place • OSC and other NCP agency reps continue to report through respective chains of command

NRP/NCP Regional Level Coordination • Public communications generally coordinated through ESF#15 – External Communications, in consultation with the JFO and Joint Information Center (JIC) • “It is recognized, however, that in some cases it may be necessary for responding OSCs to communicate with the media/public on tactical operations and matters affecting public health and safety directly from the scene, particularly during the early stages of the emergency response.”

  17. Oil/Hazmat and ESF #10 Support/Cooperating Agencies Support/Cooperating Agencies • NRT agencies are available as Support or Cooperating Agencies to EPA/USCG under both annexes • Assistance may also be requested from: • DHS Science & Technology Directorate – for scientific support as described in the Science and Technology Support Annex • DHS Information Analysis and Infrastructure Protection Directorate – for information on sites with hazardous materials

  18. ESF #10 SOP • ESF #10 SOP under development • Initial final version expected to be fairly minimal; may be revised over time to be more robust as needed
